oftheLosAngelesMunicipalCodeandamendingSection91.107.3.2oftheLosAngelesMunicipalCodetoimplementtheCompassionateUseActandtheMedicalMarijuanaProgramActconsistentwiththeprovisionsoftheActs,butwithoutviolatingstateorfederallaw.
WHEREAS,
althoughthepossessionandsaleofmarijuanaremainillegalunderbothstateandfederallaw,CaliforniavotersapprovedtheCompassionateUseAct("CUA")in1996toexemptseriouslyillpatientsandtheirprimarycaregiversfromcriminalliabilityforpossessionandcultivationofmarijuanaformedicalpurposes;and

WHEREAS,
theMedicalMarijuanaProgramActof2003("MMPA")providesfortheassociationofprimarycaregiversandqualifiedpatientstocultivatemarijuanaforspecifiedmedicalpurposesandalsoauthorizeslocalgoverningbodiestoadoptandenforcelawsconsistentwithitsprovisions;and
WHEREAS,
theCityofLosAngelesenactedanInterimControlOrdinancein2007forthetemporaryregulationofmedicalmarijuanafacilitiesthrougharegistrationprogram,whichresultedintheunintendedproliferationofstorefrontmedicalmarijuanadispensariestoanumbercurrentlyestimatedtoexceed500suchlocations,presentingaSUbstantialriskofunlawfulcultivation,sale,andtheillegaldiversionofmarijuanafornon-medicaluses;and
WHEREAS,
therehavebeenrecentreportsfromtheLosAngelesPoliceDepartmentandthemediaofanincreaseinandescalationofviolentcrimeatthelocationofmedicalmarijuanadispensariesintheCityofLosAngeles,andtheCaliforniaPoliceChiefsAssociationhascompiledanextensivereportdetailingthenegativesecondaryeffectsassociatedwithmedicalmarijuanadispensaries;and
WHEREAS,
medicalmarijuanathathasnotbeencollectivelyorpersonallygrownconstitutesauniquehealthhazardtothepublicbecause,unlikeallotheringestibles,marijuanaisnotregulated,inspected,oranalyzedforcontaminationbystateorfederalgovernmentandmay,aswithsamplesrecentlytestedbyaU.S.FoodandDrugAdministrationlaboratory,containharmfulchemicalsthatcouldfurtherendangerthehealthofpersonswhoarealreadyseriouslyillandhaveimpairedorreducedimmunities;and
WHEREAS,
theCityofLosAngeleshasacompellinginterestinensuringthatmarijuanaisnotdistributedinanillicitmanner,inprotectingthepublichealth,safetyandwelfareofitsresidentsandbusinesses,inpreservingthepeaceandquietoftheneighborhoodsinwhichmedicalmarijuanacollectivesoperate,andinprovidingcompassionateaccesstomedicalmarijuanatoitsseriouslyillresidents.

NOW,THEREFORE,THEPEOPLEOFTHECITYOFLOSANGELESDOORDAINASFOLLOWS:Section1.AnewArticle5.1isaddedtoChapterIVoftheLosAngelesMunicipalCodetoread:ARTICLE5.1MEDICALMARIJUANACOLLECTIVESEC.45.19.6.PURPOSESANDINTENT.Itisthepurposeandintentofthisarticletoregulatethecollectivecultivationofmedicalmarijuanainordertoensurethehealth,safetyandwelfareoftheresidentsoftheCityofLosAngeles.Theregulationsinthisarticle,incompliancewiththeCompassionateUseAct,theMedicalMarijuanaProgramAct,andtheCaliforniaHealthandSafetyCode(collectivelyreferredtoas"StateLaw")donotinterferewithapatient'srighttousemedicalmarijuanaasauthorizedunderStateLaw,nordotheycriminalizethepossessionorcultivationofmedicalmarijuanabyspecificallydefinedclassificationsofpersons,asauthorizedunderStateLaw.UnderStateLaw,onlyqualifiedpatients,personswithidentificationcards,andprimarycaregiversmaycultivatemedicalmarijuanacollectively.MedicalmarijuanacollectivesshallcomplywithallprovisionsoftheLosAngelesMunicipalCode("Code"),StateLaw,andallotherapplicablelocalandstatelaws.Nothinginthisarticlepurportstopermitactivitiesthatareotherwiseillegalunderstateorlocallaw.SEC.45.19.6.1.DEFINITIONS.A.Thefollowingphrases,whenusedinthisarticle,shallbeconstruedasdefinedinCaliforniaHealthandSafetyCodeSections11006.5,11018,11362.5and11362.7:"Attendingphysician;""ConcentratedCannabis;""Identificationcard;""Marijuana;""Personwithanidentificationcard;""Primarycaregiver;"and"Qualifiedpatient."B.Thefollowingphrases,whenusedinthisarticle,shallbeconstruedasdefinedbelow.WordsandphrasesnotdefinedhereshallbeconstruedasdefinedinSections11.01,12.03,45.19.5,45.21,and56.45ofthisCode.

"Location."Thelotorportionofalotthatisusedbyamedicalmarijuanacollective."Medicalmarijuana."MarijuanausedformedicalpurposesinaccordancewithCaliforniaHealthandSafetyCodeSection11362.5"Medicalmarijuanacollective("collective")."Anincorporatedorunincorporatedassociation,composedsolelyoffourormorequalifiedpatients,personswithidentificationcards,anddesignatedprimarycaregiversofqualifiedpatientsandpersonswithidentificationcards(collectivelyreferredtoas"members")whoassociateataparticularlocationtocollectivelyorcooperativelycultivatemarijuanaformedicalpurposes,instrictaccordancewithCaliforniaHealthandSafetyCodeSections11362.5,

"Memberengagedinthemanagement."Amemberwithresponsibilityfortheestablishment,organization,registration,supervision,oroversightoftheoperationofacollective,includingbutnotlimitedtomemberswhoperformthefunctionsofpresident,vicepresident,boardmember,director,owner,operatingofficer,financialofficer,secretary,treasurer,ormanagerofthecollective."Privatemedicalrecord."Documentationofthemedicalhistoryofaqualifiedpatientorpersonwithanidentificationcard."Privatemedicalrecord"shallnotincludetherecommendationofanattendingphysicianordoctorforthemedicaluseofmarijuana,anidentificationcard,orthedesignationofaprimarycaregiverbyaqualifiedpatientorbyapersonwithanidentificationcard."Reasonablecompensation."CompensationcommensuratewithreasonablewagesandbenefitspaidtoemployeesofIRS-qualifiednon-profitorganizationswhohavesimilarjobdescriptionsandduties,requiredlevelofeducationandexperience,priorindividualearningshistory,andnumberofhoursworked.Thepaymentofabonusshallnotbeconsidered"reasonablecompensation."SEC.45.19.6.2.REGISTRATION.A.RegistrationRequired.Nocollectiveshalloperateuntilafterithasfiledaregistrationforminaccordancewiththeprovisionsofthisarticle,haspaidanyadoptedregistrationfees,anditsregistrationhasbeenacceptedascompletebytheDepartmentofBuildingandSafety.B.MaximumNumberofCollectives.1.ThemaximumnumberofcollectivesintheCityshallbecappedat70.However,theremaybefewerthan70collectivesifsufficientlocationsdonotexistconsistentwithSection45.19.6.3A.2ofthisarticlefor70collectives.TothefullestextentthatlocationsconsistentwithSection45.19.6.3A.2ofthisarticleexist,the
