iOTICE TO DISCONTINUE ILLEGAL USE OF PREMISES
This is officiel Notice from the District of Columbia Department of Consumer and
Regulatory Affairs (*DCRA”) that Philly Pizza & Grill (“Philly Pizza”) does not have a
certificate of occupancy to operate a restaurant or a fast food establishment at 1211
Potomac Street, N.W. The District of Columbia's zoning regulations and Building Code
do not permit operation of a restaurant or a fast food establishment without a certificate
of occupancy.
On February 16, 2010, the Board of Zoning Adjustment (“Board”) unanimously affirmed
the Zoning Administrator's revocation of Certificate of Occupancy # 0903354, thereby
lifting a stay of revocation previously issued by the Board, As a result, Philly Pizza must
immediately cease operations at 1211 Potomac Street, N.W., upon service of this Notice.
If DCRA determines that Philly Pizza is continuing, after service of this Notice, to
‘operate at these premises, DCRA will request that the Office of the Attorney General for
the District of Columbia seek emergency injunctive relief in the D.C. Superior Court, on
or after February 22, 2010, pursuant to the Attorney General’s authority under D.C. Code
§ 6-641.09.
