His Honour Judge Henrik Tonning
Lacknowledge receipt of your letter dated September 21, 2004 designating me
pursuant to s. 6.7(1) of the Provincial Court Act to receive a report from Chief Justice
‘Dumas in this matter.
I received that report on October 4, 2004 and reviewed it. I paid particular
attention to the transcripts of the proceedings in the Provincial Court, In my opinion
there was no misconduct on the part of Judge Toning
Pursuant to s. 6.7(3) of the Provineial Court Act, I therefore recommend that an
inquiry not be held.

Pursuant {0 s, 6.6(1) of the Provincial Court Act, R.S.N.B. 1973, ¢, P-21, the
Chief Justice of New Brunswick has referred to Chief Judge Camille Dumas your written
communication of September 10, 2004 alleging misconduct on the part of His Honour
Judge Henrik Tonning of the Provincial Court. As well, the Chief Justice of New
Brunswick has designated The Honourable Mr. Justice Roger Savoie of the Court of
Queen’s Bench to receive Chief Judge Dumas’ report
