The Colorado Supreme Court affirms the trial court’s orderimposing a preliminary injunction on the campaign financerestrictions of Amendment 54. The supreme court holds that theplaintiffs are likely to succeed on the merits of their claimthat Amendment 54 is unconstitutional under the First Amendment.The supreme court holds that provisions of Amendment 54 areunconstitutionally overbroad, vague, and violate equalprotection. After striking the unconstitutional portions ofAmendment 54, the supreme court holds that the remainingprovisions do not constitute a meaningful legislative enactment,and therefore the entire Amendment must be purged from theColorado Constitution. The supreme court affirms the trialcourt’s preliminary injunction and remands the case for furtherproceedings consistent with this opinion.
