10-02-24 Notice to Los Angeles county supervisors of complaints against LA Sheriff's

Department - for large-scale false arrests and jailings and other alleged violations of
the law

Sheriff Lee Baca_ _ Los Angeles County Board of Supervisors

To the Honorable LA County Supervisors:

RE: Notice to the Honorable Los Angeles County Supervisors of Complaints against
Los Angeles County Sheriff's Department filed with Los Angeles County Ombudsman
Stephanie Maxberry, and request for assistance by the Honorable Michael
Antonovich, Los Angeles County Supervisor in ascertaining adequate investigations.

Please take notice of the complaints against the Los Angeles County Sheriff's Department, copied
below, alleging Human Rights abuses of historic proportions in Los Angeles County, California,
including, but not limited to:

a) Routine arrests and jailing with no valid warrants, covered up through the false data entered
in the fraudulent online Inmate Information Center;

b) Routine refusal of the Sheriff's Department to allow access to true arrest and booking
records, to cover up such false arrests and bookings, instead providing the false data from
the online Inmate Information Center - such conduct amounts to disregard of California
Public Records Act, Cal Gov Code §6254(f);

c) Corruption of bail/bond services and alleged large-scale embezzlement of public funds,

where all bail/bonds are listed in the fraudulent online Inmate Information Center at $0.00,
and no records of the monetary transactions with the Sheriff's Department are provided to
the inmates;
 Page 2/13 February 24, 2010

d) Misprision of felonies by the Sheriff's Department, and allowing and cover up of vigilantism
by bail/bond services;

e) Robbery of personal valuable.

Conditions of the justice system in Los Angeles County are deemed a direct extension of the
Rampart scandal (1998-2000), whose thousands of victims, the Rampart FIPs (Falsely Imprisoned
Persons), are yet to be freed.

The general claim is that the Sheriff's Department of Los Angeles County implemented and is
operating fraudulent case management systems, which allow the large-scale deprivation of Liberty
of persons in Los Angeles County, large-scale embezzlement of bail/bond moneys, and other
violations of the law.

The proposed solution - publicly accountable validation (certified functional logic verification)
of the computer systems of the Los Angeles County Sheriff's Department, and strict enforcement of
compliance with California Public Records Act Govt Code §6254(f). Our right to access public
records, our Liberty and other Human Rights are all connected at the hips. The position of the Los
Angeles County justice system, as articulated by well-connected sources is that "computer systems,
by nature, do not lend themselves to validation". There is nothing further from the truth.
Computer systems lend themselves to highly secure methods of validation much better than any
comparable paper-based system.

Please also notice that lack of validity and security in other Los Angeles County computer systems
was likewise previously noted as a key deficiency by the Los Angeles County independent auditors,
KMPG, Los Angeles.

Furthermore, credible evidence was previously presented to the Honorable Supervisors, and a
preliminary expert opinion letter also supported claims of the fraudulent nature of the computer
systems of the Los Angeles County Superior Court itself. Furthermore, large scale embezzlement of
public funds by the Los Angeles Superior Court was alleged as well, where funds were routinely
listed as "Journal Entry", and the Clerk of the Court refused to disclose the ultimate designation of
such funds. Likewise, the failure and refusal of the Los Angeles Superior Court to publish audited
financial statements remained inexplicable for an honest court. Los Angeles County agencies
claimed that they have no authority to examine the computer systems of the Los Angeles Superior
Court itself, or to audit the financial conduct of the Court. However, one should note that the call
for an audit of the operations of the Los Angeles Superior Court was consistent with
recommendations of the Blue Ribbon Review Panel report (2006), which recommended an
 Page 3/13 February 24, 2010

"external examination" of the Los Angeles County justice system. The same report also singled out
the Los Angeles County Superior Court as worthy of examination.

One should also note in this regard the growing evidence of widespread corruption of judges of the
San Bernardino Superior Court, where the San Bernardino Sentinel recently called for investigation
of the judges as the "next logical focus" as part of the growing corruption scandal there.

This notice is also a request for assistance by the Honorable Michael Antonovich, Supervisor of LA
County, in ensuring adequate investigation of the complaints and adequate actions in this regard by
Los Angeles County Ombudsman Stephanie Maxberry.

Respectfully,
Dated: February 24, 2010

To Stephanie Maxberry, Ombudsman, Los Angeles County, California
Complaint #5 - False arrests and jailing of Joseph Zernik on February 6 and February 19, 2010 - and
request for a complaint ID number.
Dear Ombudsman Maxberry:

Pursuant to the guidelines you have previously outlined, please accept this notice as a request for your
assistance in "fil[ing] a complaint, find[ing] out the status of your complaint, review[ing] your complaint to make
sure a thorough process was done".

Complaint #5 is similar in nature to previous complaints that pertained to false arrests and false hospitalizations
in Los Angeles County by the Sheriff's Department. The novelty in Complaint #5 is that in this particular case it
was in fact possible to access court files, where such access was denied in other cases, in disregard of First
Amendment rights. Therefore, in instant complaint it was possible to fully ascertain:
a) That no valid warrants for the arrests existed in the first place.
b) That regardless of the absence of such valid warrants, the Sheriff's Department proceeded with false
booking and jailing.
c) That in covering up the lack of valid warrants, the Sheriff's Department created false records in its Booking
Records and in in its online Inmate Information Center.
d) That beyond the false arrest and jailing, additional deceitful manipulations were conducted in such systems,
to create the impression of an outstanding warrant, even after the invalid warrant from the Burbank Court was
purportedly executed.
The details of the case were provided below.

The general claim is that the Sheriff's Department of Los Angeles County implemented and is operating a
fraudulent case management systems which allow the large-scale deprivation of Liberty of persons in Los
Angeles County. The solution - publicly accountable validation (certified functional logic verification) of such
systems and compliance with California Public Records Act Govt Code §6254(f)
Please confirm receipt of this notice and initiating of complaint process with the Sheriff's Department. I would
appreciate it if you could also forward to me the 5-6 digit ID number of Complaint #5, once such number is
issued by the Sheriff's Department.

Complaint #6 - Misprision of Felonies by the Sheriff's Department in re: Armed abduction of Joseph
Zernik by Richard Rodriguez and Javier on February 19, 2010 - and request for a complaint ID number.
Dear Ombudsman Maxberry:

Pursuant to the guidelines you have previously outlined, please accept this notice as a request for your
assistance in "fil[ing] a complaint, find[ing] out the status of your complaint, review[ing] your complaint to make
sure a thorough process was done".

Complaint #6 is a novel issue, specific to the case at hand. On February 19, 2010, Joseph Zernik was
abducted, robbed and extorted at gun point in La Verne, California, by Richard Rodriguez, and Javier. The
Sheriff's Department recognized the unlawful nature of the abduction, and refused to accept Joseph Zernik into
custody from such individuals. However, in view of such felonies, the Sheriff's Department did not intervene to
stop the disregard of the law. Instead, the Sheriff's Department proceeded to create false records for the arrest
and booking to cover up the unlawful armed abduction.
The details of the case were provided below.

Please confirm receipt of this notice and initiating of complaint process with the Sheriff's Department, by
forwarding back to me the 5-6 digit ID number of complaint #6, once such numbers is issued by the Sheriff's

assistance in "fil[ing] a complaint, find[ing] out the status of your complaint, review[ing] your complaint to make
sure a thorough process was done".

Complaint #7 is not a novel issue - it is a repeat of conduct that was previously observed in the cases of
Inmates Richard Fine and Ronald Gottschalk, and others, whose arrest and booking records I have requested
for months. In none of the cases did the Sheriff's Department allow access to true arrest warrants or true
Booking Records. Instead, in cases where it allowed access - it was only to false records in the online Inmate

Complaint #8 is not a novel issue - it is a repeat of conduct that was previously observed in the cases of Inmate
Ronald Gottschalk, and others, whose bail/bond was invariably listed as $0.00, where in fact large sums of
money were paid in bond to the Sheriff's Department - albeit - no records of the transactions are published

Sequence of Events
1) On February 6, 2010, Dr Zernik was stopped by Officer McKindley of La Verne Police, and was informed
that two warrants for his arrest were outstanding.
2) In Booking records Officer McKindley likewise listed two warrats, one from a Beverly Hills Court, with bond of
$30,000, the other from a Burbank Court, with bond of $5,000, both for violation of the vehicle code.
3) Officer McKindley denied access to the executed warrants, to inspect and to copy, and likewise, La Verne
Police denied all later requests to access to the warrants, to inspect and to copy, in disregard of the California
Public Records Act.
4) On Sunday, February 7, 2010, Dr Zernik called Erika Higgins, Bond Services, and asked to issue bond for
$35,000. Erika checked the Los Angeles Sheriff's online Inmate Information Center, and confirmed that the
bond would have to be for $35,000.
5) On Sunday, February 7, 2010, Erika in formed Dr Zernik that his file was "updated" and that the bond was
"reduced" to $30,000.
 Page 10/13 February 24, 2010

6) Dr Zernik was alarmed, since it appeared as potentially deceitful manipulation of the records, allowing a
warrant that was purported to have been executed to remain outstanding, requiring him to post bond of
$30,000, but at the same time, leaving him subject to another arrest at any time. Therefore, Dr Zernik
stipulated with Erika Higgins by phone that he would pay an initial payment by cash, and that Erika Higgins
would provide the paperwork to support the legal foundation of the arrest and bail, and in particular the "bond
reduction". After such paperwork was supplied, Dr Zernik was to pay the balance. Erika Higgins promised to
provide the paperwork immediately upon release.
7) Erika Higgins never provided that paperwork upon release on February 7, 2010, but promised to fax or
email it first thing in the morning on February 8, 2010. However, to this date, Erika Higgins never provided the
paperwork to support the legal foundation of the arrest, bail, and "bond reduction". Therefore, by Saturday,
February 13, 2010, Dr Zernik place stop payment on his payment check.
8) On Sunday, February 7, 2010, in the evening, and all further times, the Sheriff's online Inmate Information
Center listed the Burbank Warrant as issued by the Burbank Municipal Court, which no longer existed for
almost a decade. The system also listed the bond at $0.00. The false listing of bond at $0.00 was a common
feature of the system, and subject of a previous complaint to the Los Angeles Ombudsman, alleging corruption
of bond/bail services, and likely large-scale embezzlement of public funds.
9) On Tuesday, February 16, 2010, Dr Zernik attempted to access his court file in Beverly Hills, access was
denied, in disregard of First Amendment rights.
10) On Tuesday, February 16, 2010, Dr Zernik attempted to access his court file in Burbank. No valid warrant
was found in the file. However, the manager of the Clerk's Office advised Dr Zernik that a warrant for his arrest
was outstanding, and was never executed.
11) On Wednesday, February 17, 2010, in the afternoon/evening, Dr Zernik's car tires were punctured, he was
subjected to violent attack on his residence, where an unknown person threaten to break the door in, and he
received a threatening fax from Erika Higgins, Richard Rodriguez, and Javier.
12) On Thursday, February 18, 2010, Dr Zernik called the La Verne Police Department and requested to file
an application for a California Crime Report regarding the puncturing of his tires and the attack on his door.
Application DR#2010-0584 was taken by Officer Matt Hadan. Dr Zernik provided the names of Erika Higgins,
Richard Rodriguez, and Javier as suspect, with their phone numbers. One of the officers who accompanied
Officer Matt Hadan called Richard Rodriguez, and then informed Dr Zernik that Rodriguez was a "retired
bounty hunter", that the conduct that Dr Zernik was subjected to was merely "business transactions", and that
Dr Zernik was supposed to open the door under the violent attack the previous night. Dr Zernik informed the
officer that he was not in the habit of opening his door to uninvited, unidentified violent intruders. Officer Matt
Hadan advised Dr Zernik to call police if such conduct recurred.
13) On Thursday, February 18, 2010, Dr Zernik explained to Officer Hadan the problem with Erika Higgins,
surrendered, and requested to be arrested by La Verne Police. Officer Matt Hadan refused to arrest Dr Zernik.
Dr Zernik also informed Erika Higgins in writing of his surrender to La Verne Police, and refusal of La Verne
Police to arrest him.
14) On Thursday evening, Dr Zernik fixed his car at a cost of about $800.00.
15) On Friday, February 19, 2010, Dr Zernik appeared in the Burbank Court and resolved any matter pending
there. At that time, no valid warrant was found on file, but a printout listed a previous warrant was "recalled" -
not executed.
16) On Friday, February 19, 2010, around noontime, upon returning home, Dr Zernik was held at gun point by
Richard Rodriguez and Javier, dressed in a black ninja outfit, and armed with a Beretta, and a shortened barrel
M.A.C. 56 rifle.
 Page 11/13 February 24, 2010

17) On Friday, February 19, 2010, around noontime, Richard Rodriguez and Javier, at gun point, robbed Dr
Zernik of his wallet, his California ID, his credit cards and other records in his wallet, and his home and car
keys.
18) On Friday, February 19, 2010, around noontime, Richard Rodriguez and Javier handcuffed Dr Zernik and
held him handcuffed for the next eight hours.
19) On Friday, February 19, 2010, Richard Rodriguez informed Dr Zernik that he was going to surrender Dr
Zernik to LA Sheriff, for refusal to pay the bond fees, and that they were going to transport him to Twin Towers
jail in Los Angeles.
20) On Friday, February 19, 2010, from La Verne, Richard Rodriguez and Javier did not transport Dr Zernik to
Twin Towers jail. Instead, they transported him to a location in Southgate, California, and while handcuffed,
attempted to extract moneys from him. Dr Zernik refused to pay any moneys whatsoever.
21) Around 4:00 pm 2010, Richard Rodriguez instructed Javier to transport Dr Zernik to Twin Towers jail.
Javier was uninformed regarding the address or driving direction to the jail, and Dr Zernik, upon noticing that he
was driving in wrong direction, on 10 freeway, heading west past Culver City, had to argue with Javier every
turn of the way, directing him back to Twin Towers jail.
22) Upon arriving at Twin Towers jail Javier had obvious problems in completing the required paperwork.
Eventually it turned out that he had no license/authority to conduct an arrest. Although the Sheriff's Department
took his papers and issued a booking number time 16:53pm, the Sheriff's Department refused to accept Dr
Zernik into custody from Javier.
23) On its online Inmate Information Center, the Sheriff's Department falsely listed the arrest as:
Arrest Date: 02/19/2010 Arrest Time: 1730 Arrest Agency: 9400 Agency Description: LASD-CITIZENS ARREST
24) Upon rejection of the unlawful arrest by Javier, Javier called Richard and asked Richard to come over to
Twin Towers and complete the surrender. As it turned out, Richard had no license/certificate/authority to
conduct such arrest either, and therefore, Richard refused to come to Twin Towers.
25) Javier then transported Dr Zernik back to the Southgate location, still handcuffed. Again, attempt was
made to extort moneys from Dr Zernik, and again, Dr Zernik refused to yield to armed extortion.
26) On Friday, February 19, 2010, around 6:00pm, Richard Rodriguez finally called and hired a person
identified as "Dave", who introduced himself as a "private investigator" to execute the surrender. Dave and his
companion, Albert, then transported Dr Zernik to Twin Tower again, arriving there around 8:00pm.
27) On Friday, February 19, 2010, around 8:00pm, upon entering custody by LA Sheriff's Department, Dr
Zernik still had in his possession a Braun brand tungsten wrist watch, replacement value about $500.00. The
Unnamed Sheriff Deputy who accepted Dr Zernik into custody removed the watch from Dr Zernik's possession
and passed it on to Dave.
28) Less than a minute later, the same Sheriff Deputy demanded that Dr Zernik sign that he entered sheriff's
custody with no possession at all except for his clothing. Dr Zernik refused to sign the form, part of the sheriff's
standard records.
29) The Unnamed Sheriff's Deputy then violently pushed Dr Zernik into a solitary confinement cell, where Dr
Zernik was handcuffed to a 2-3 feet chain on the floor, and where he was left barefoot, insufficiently dressed at
the prevalent temperature of about 65 F. Log of the solitary confinement was created, posted outside the door,
and Sheriff Deputies signed it every 30 minutes or so.
30) Dr Zernik was left in the solitary confinement cell for about 4 hours. Two times during that period, Sheriff's
Deputies entered the cell, and tried to extort his signature on the possessions form, calling him "asshole", and
yelling at him for his refusal to "go along with the program". One of the deputies also threatened to "split your
head open" with his flashlight/club. The Deputies also refused to allow Dr Zernik to urinate in the toilet provided
 Page 12/13 February 24, 2010

in the solitary confinement cell. Therefore, at around 11:00-12:00 midnight Dr Zernik finally urinated on the
floor of the cell.
31) Around midnight, Dr Zernik was finally violently removed from the solitary confinement cell, and a his
"reception" process was continued.
32) Booking time was falsely listed in the onlin Inmate Information Center as:
Date Booked: 02/20/2010 Time Booked: 0023 Booking Location: IRC Location Description: IRC
33) On Monday, February 22, 2010, Dr Zernik was transported to Beverly Hills Court, where he resolved his
outstanding matter. Upon review and repeat review of the court file at that time, no valid warrant was found in
the court file. No record of execution of a warrant by the La Verne Police was found either.
34) On Monday, February 22, 2010, around 4:30pm, Dr Zernik was released by the Beverly Hills Sheriff's
Deputy.
35) On Tuesday AM, February 23, 2010, Dr Zernik called the La Verne Police Department and requested to
filed an application for a California Crime Report, for armed abduction, armed robbery, armed extortion, and
false arrest by Erika Higgins, Richard Rodriguez, and Javier, and collusion by Dave in the false arrest and
armed robbery. La Verne Police was provided with phone numbers:
Erika Higgins: Cell: 323.564.5000; Office: 323.350.6493
Richard Rodriguez: 562.833.2149
36) La Verne Police was also requested to facilitate the return of robbed possessions.

Dear Chief Pickwith:

I am writing to request that an Daily Log Number be issued relative to my phone to La Verne Police
Department earlier this morning. I just got off the phone with Lieutenant Garcia, who refused to issue a Log
Number. Instead she issued Number 005, which she stated referred to nothing at all.

Relative to the conduct of Richard Rodriguez, Javier, and Erika Higgins, who stopped me, arrested me, and
robbed me at gun point, with no license, no certificate, and no legal authority, as evidenced by refusal of LA
County Sheriff's Department to accept me into custody from them - Lieutenant Garcia claimed that it was
my fault, since I created the circumstances.

Regarding the armed robbery of my valuables - Lieutenant Garcia refused to assist in retrieving those items.

Your urgent attention is kindly requested to this matter.

Truly,
