Dear Clerk O’Hagan Wolfe:
Please accept this request for access to court records - to inspect and to copy - pursuant to First
Amendment rights and Nixon v Warner Communications, Inc (1978), where the common law
right to access court records was re-affirmed by the US Supreme Court decision, as a right
embedded in the various Amendments to the US Constitution, including, but not limited to the
First Amendment.
Request is for a certified copy of the November 5, 2004, Summary Order, as served on parties in
the case, including, but not limited to the respective attestation by Clerk of the Court, as a Notice
of Electronic Filing (NEF) in CM/ECF, or its equivalent in your court.
I previously attempted to access such records on December 30, 2009, but my request was flatly
denied by staff of your office, Jeannine Cook, with no explanation at all. In case access would be
again denied, I would greatly appreciate an explanation. In case access is permitted, please let
me know the costs, so that I may immediately forward to you the correct payment in whatever
form is requested.
