This Act may be cited as the \u2018\u2018Health Insurance In-

SEC. 2. RESTORING THE APPLICATION OF ANTITRUST

LAWS TO HEALTH SECTOR INSURERS.

(a) AMENDMENT TOMCCARRAN-FERGUSONACT.\u2014
3
Section 3 of the Act of March 9, 1945 (15 U.S.C. 1013),
4
commonly known as the McCarran-Ferguson Act, is
5
amended by adding at the end the following:
6
\u2018\u2018(c) Nothing contained in this Act shall modify, im-
7
pair, or supersede the operation of any of the antitrust
8
laws with respect to the business of health insurance. For
9
purposes of the preceding sentence, the term \u2018antitrust
10
laws\u2019 has the meaning given it in subsection (a) of the
11
first section of the Clayton Act, except that such term in-
12
cludes section 5 of the Federal Trade Commission Act to
13
the extent that such section 5 applies to unfair methods
14
of competition.\u2019\u2019.

(b) RELATEDPROVISION.\u2014For purposes of section
16
5 of the Federal Trade Commission Act (15 U.S.C. 45)
17
to the extent such section applies to unfair methods of
18
competition, section 3(c) of the McCarran-Ferguson Act
19
shall apply with respect to the business of health insurance
20
without regard to whether such business is carried on for
21
profit, notwithstanding the definition of \u2018\u2018Corporation\u2019\u2019
