Toamendtitle18,UnitedStatesCode,toprohibitahealthcarepractitionerfromfailingto
exercisetheproperdegreeofcareinthecaseofachildwhosurvivesanabortionor
attemptedabortion.

SECTION1.SHORTTITLE.
ThisActmaybecitedasthe`BornAliveAbortionSurvivorsProtectionAct'.

SEC.2.FINDINGS.
Congressfindsasfollows:
(1)Ifanabortionresultsinthelivebirthofaninfant,theinfantisalegal
personforallpurposesunderthelawsoftheUnitedStates,andentitledtoall
theprotectionsofsuchlaws.
(2)Anyinfantbornaliveafteranabortionorwithinahospital,clinic,orother
facilityhasthesameclaimtotheprotectionofthelawthatwouldariseforany
newborn,orforanypersonwhocomestoahospital,clinic,orotherfacilityfor
screeningandtreatmentorotherwisebecomesapatientwithinitscare.

SEC.3.BORNALIVEINFANTSPROTECTION.
(a)RequirementsPertainingtoBornAliveAbortionSurvivorsChapter74oftitle18,
UnitedStatesCode,isamendedbyinsertingaftersection1531thefollowing:
`Sec.1532.Requirementspertainingtobornaliveabortionsurvivors
`(a)RequirementsforHealthCarePractitionersInthecaseofanabortionor
attemptedabortionthatresultsinachildbornalive(asdefinedinsection8oftitle
1,UnitedStatesCode(commonlyknownasthe`BornAliveInfantsProtection
Act')):
`(1)DEGREEOFCAREREQUIREDIMMEDIATEADMISSIONTOAHOSPITAL
Anyhealthcarepractitionerpresentatthetimethechildisbornaliveshall
`(A)exercisethesamedegreeofprofessionalskill,care,anddiligenceto
preservethelifeandhealthofthechildasareasonablydiligentand
conscientioushealthcarepractitionerwouldrendertoanyotherchild
bornaliveatthesamegestationalageand

`(B)followingtheexerciseofskill,care,anddiligencerequiredunder
subparagraph(A),ensurethatthechildbornaliveisimmediately
transportedandadmittedtoahospital.
`(2)MANDATORYREPORTINGOFVIOLATIONSAhealthcarepractitioneror
anyemployeeofahospital,aphysician'soffice,oranabortionclinicwhohas
knowledgeofafailuretocomplywiththerequirementsofparagraph(1)shall
immediatelyreportthefailuretoanappropriateStateorFederallaw
enforcementagency,ortoboth.
`(b)Penalties
`(1)INGENERALWhoeverviolatessubsection(a)shallbefinedunderthis
titleorimprisonedfornotmorethan5years,orboth.
`(2)INTENTIONALKILLINGOFCHILDBORNALIVEWhoeverintentionally
performsorattemptstoperformanovertactthatkillsachildbornalive
describedundersubsection(a),shallbepunishedasundersection1111ofthis
titleforintentionallykillingorattemptingtokillahumanbeing.
`(c)BartoProsecutionThemotherofachildbornalivedescribedundersubsection
(a)maynotbeprosecutedunderthissection,forconspiracytoviolatethissection,
orforanoffenseundersection3or4ofthistitlebasedonsuchaviolation.
`(d)CivilRemedies
`(1)CIVILACTIONBYAWOMANONWHOMANABORTIONISPERFORMEDIfa
childisbornaliveandthereisaviolationofsubsection(a),thewomanupon
whomtheabortionwasperformedorattemptedmay,inacivilactionagainst
anypersonwhocommittedtheviolation,obtainappropriaterelief.
`(2)APPROPRIATERELIEFAppropriatereliefinacivilactionunderthis
subsectionincludes
`(A)objectivelyverifiablemoneydamageforallinjuries,psychological
andphysical,occasionedbytheviolationofsubsection(a)
`(B)statutorydamagesequalto3timesthecostoftheabortionor
attemptedabortionand
`(C)punitivedamages.
`(3)Attorney'sFEEFORPLAINTIFFThecourtshallawardareasonable
attorney'sfeetoaprevailingplaintiffinacivilactionunderthissubsection.
`(4)Attorney'sFEEFORDEFENDANTIfadefendantinacivilactionunderthis
subsectionprevailsandthecourtfindsthattheplaintiff'ssuitwasfrivolous,the
courtshallawardareasonableattorney'sfeeinfavorofthedefendantagainst
theplaintiff.
`(e)DefinitionsInthissectionthefollowingdefinitionsapply:
`(1)ABORTIONTheterm`abortion'meanstheuseorprescriptionofany
instrument,medicine,drug,oranyothersubstanceordevice
`(A)tointentionallykilltheunbornchildofawomanknowntobe

pregnantor
`(B)tointentionallyterminatethepregnancyofawomanknowntobe
pregnant,withanintentionotherthan
`(i)afterviability,toproducealivebirthandpreservethelifeand
healthofthechildbornaliveor
`(ii)toremoveadeadunbornchild.
`(2)ATTEMPTTheterm`attempt',withrespecttoanabortion,means
conductthat,underthecircumstancesastheactorbelievesthemtobe,
constitutesasubstantialstepinacourseofconductplannedtoculminatein
performinganabortion.'.
(b)ClericalAmendmentThetableofsectionsforchapter74oftitle18,United
StatesCode,isamendedbyinsertingaftertheitempertainingtosection1531the
following:
`1532.Requirementspertainingtobornaliveabortionsurvivors.'.
