November 13, 2015, ‘The Honorable Jeh Johnson, Secretary USS, Department of Homeland Security ‘Washington, D.C. 20528 Dear Secretary Johnson, ‘We write to express our appreciation for the recent U.S. Department of Homeland Security's Real ID Act briefing, and our commitment to ensuring that Minnesota citizens continue to have full access 1 public facilities, We believe compliance can be accomplished while addressing concems related to privacy and security, as wel as logistical and financial challenges that have been raised by interested citizens and lawmakers. With these goals in mind, we respectfully request an extension for compliance with Real ID requirements that will ensure continued access to federal buildings and airports for Minnesota citizens. Although the Legislature does not meet again until March 2016, state leaders are committed to working on an agreement that respects privacy and security, and will put Minnesota fon the road to compliance by the end of next session. The Legislative Commission on Data Practices has already held one hearing on Real ID compliance, and plans to continue working on As you know, New Hampshire was recently granted an extension for compliance with Real ID requirements until June 1, 2016. In addition, a dozen other states have received an extension for compliance with various élements of Real ID until October 10, 2016. According to DHS's “Real ID Enforcement In Brief” page, driver's licenses from these states will continue to be accepted by federal agencies until those dates We ask that Minnesota citizens be granted the same treatment, Despite the 2009 compliance prohibition, we have acted in bipartisan fashion to greatly enhance the security of Minnesota driver's licenses. Currently, Minnesota's standard license meets 32 of the 43 federal Real ID requirements. Our state also offers an Enhanced Driver's License (EDL) that meets federal requirements to board an aircraft and access federal facilities. The key remaining difference between EDL and Real ID is the type of security marking, which we believe can be resolved during next session's deliberations. We fear that barring access to Minnesotans secking to enter public facilities could result in lost ‘economic activity, and unnecessarily disrupt access for Minnesota vendors that supply critical services and equipment tothe federal government ‘Thank you for your prompt attention to this important mater.
