COMPLAINT FOR DECLARATORY AND INJUNCTIVE RELIEF
Plaintiff Association of American Physicians and Surgeons, Inc. (“AAPS”) seeksdeclaratory and injunctive relief based on the following allegations.
NATURE OF THE ACTION
1.AAPS brings this action under the Medicare Act (“Medicare”), the SocialSecurity Act (“Social Security”), the Administrative Procedure Act (“APA”), various restrictionson federal action in Article I of the U.S. Constitution, and the Fifth and Tenth Amendments toenjoin Defendants Sebelius and Astrue (collectively, “Defendants”) from compelling AAPSmembers to participate in Medicare Part A as a condition of receiving Social Security benefitsand to purchase health insurance approved by Defendant Sebelius.
