DUBBS: Mr. Chief Justice, and may itplease the Court:Given that the issue of subject matterjurisdiction appears not to be in dispute, the issuesbefore the Court today are:First, the scope of section 10(b) of the1934 Exchange Act when applied to alleged fraudulentconduct with respect to financial information that is tobe sent to Australia for incorporation into thefinancial statements of the Respondent, NationalAustralia Bank.And second, the reasonableness of theapplication of the statute under these circumstances andthe norms of enforcement pursuant to the private causeof action or otherwise.JUSTICE SCALIA: I guess there's also theissue of whether, if everybody is agreed that it is not
