STATEMENT REGARDING ORAL ARGUMENT
The record in this case is large and the procedural history is complex.The main legal question concerns whether the EPA employee’s retaliatoryconduct against a whistleblower can be impugned to his employer. This is amixed question of law and fact subject to
de novo
review. Oral argumentwould assist this Court in understanding the facts found by the Departmentof Labor’s (DOL’s) Administrative Review Board (ARB), in understandingwhich issues were not addressed by the ARB, and in narrowing and focusingthe legal issues that apply to this case. This Court, given these factors, wouldgreatly benefit from oral argument.
