First, United States law does not prevent companies based in this country from doing business in Zimbabwe. Indeed, there are a variety of U.S. companies that regularly conduct business there. Federal law does prevent U.S. companies from doing business with select individuals and entities in Zimbabwe that are identified on a specific watch list. You, however, have identified no information demonstrating or even suggesting that Mikhail Prokhorov or any of his related companies conducts business with these individuals or entities, and we are not otherwise aware of any such information Second, the Executive Order that you cite does not even apply to Mr. Prokhorov, a Russian national, or his companies, which are not based in the United States. As a result, the NBA is continuing to move forward with Mr. Prokhorov's application for approval as new owner of the New Jersey Nets. Sincerely, nl foel M.
