PublicEnginesisaserviceprovidertolawenforcementagenciesacrosstheUnitedStates.Ithasdevelopedacomprehensivesuite
of
softwareandassociatedelectronicservicesthatenablelawenforcementagenciestomakeavailabletothecommunitiestheyserveincident-levelcrimereportsinnearrealtime.Itsproprietarysoftware,whichisusedinconjunctionwiththelawenforcementagency'sdispatchandrecordssystems,generatescrimereportsthatarelimitedtoinformationtheagencieshavedeterminedmayproperlybepubliclyreleased.PublicEngines'employeesanditssoftwareproductsthenfurtherrefinethatdatasotheycanbedisplayed
on
PublicEngines'webpage,CrimeReports.com,therebyprovidingan"official"sitefromwhichmembers
of
thepubliccanobtainthisinformationforfree.Theinformationispresentedinauniqueformatthatenablesmembers
of
thepublictounderstandit.PublicEnginescurrentlyemploysmorethan
35
employeesatitsfacilitiesinDraper,Utah.Overthelastthreeyears,PublicEngineshasinvestedmorethan
$3
milliontodevelop,maintain,andlicensetechnologyandsupportingservices.

ReportSeeoperatesSpotCrime.comandotherwebsitesandservices,whichmakecommercialuse
of
incident-levelcrimereports,thoughnotinconjunctionwithlawenforcementagencies.ReportSeeclaimsthatitgatherstheinformationreportedonitswebsitesfromvariouspublicsources.Inreality,however,much
of
theinformationonSpotCrime.comandother
of
itswebsiteshasbeenmisappropriateddirectlyfromCrimeReports.com.In2008,PublicEngineslearnedthatReportSeewasmisappropriatingcrimereportdatafromCrimeReports.comusinga"scraper"-anautomatedsoftwaretoolthatquerieswebpages,gathersdata,anddownloadsthemforsubsequentuse.ReportSeedidsoinviolation
of
theexplicitterms
of
useforCrimeReports.com,andinviolation
of
federalandstatelaw.AfterPublicEnginesdemandedthatReportSeeimmediatelystop,thelatterconfirmedinwritingthatitwoulddoso,andforatimeappearedtohonorthatcommitment.

Inlate2009,however,ReportSeesurreptitiouslyresumedthemisappropriation
of
datafromCrimeReports.comusinganautomatedscraper.WhenPublicEnginesmodifieditswebpagesoReportSee'scomputercouldnotaccessit,ReportSeechangedtoadifferentcomputeridentifiedonlybyanIPaddress,whichiseffectivelyanonymous.PublicEnginesthenattemptedtodeployothertechnicalmeasuresandroadblockstopreventReportSeefrommisappropriatingPublicEngines'data.Eachtime,however,ReportSeemodifieditsscrapertocircumventPublicEngines'roadblocks.DespiteitsearliercommitmenttorefrainfromscrapingdatafromCrimeReports.com,ReportSeecontinuedthroughMarch2010tomisappropriatetheinformation,andcontinuestodisplayitonSpotCrime.comandperhapsotherwebsitesandthroughotherservicesitmaintains,andsellthatinformationtothirdparties,allwithouttheconsent
of
PublicEnginesanditslawenforcementcustomers.

ReportSeealsohascontactedPublicEngines'lawenforcementcustomersanddemandedthattheyprovideReportSeewiththedatacreatedfromPublicEngines'softwareprograms.ReportSeehasmadeunfoundedclaimsthattheseagenciesmustdisclosethisinformationpursuanttopublicrecordsaccesslaws,andithasdisparagedtheseagencies'
