Section 1. Section 134 of the civil service law is amended by adding a
new subdivision 8 to’ read as follows:
8. __{a) Notwithstanding any other provisions of this section or of an}
other law, including article fourteen of this chapter, or collective
bargaining agreement or other analogous contract or binding interest
arbitration award, the work week of officers and employees of the execu-
tive branch, including temporary and seasonal employees under article
fourteen of this chapter, shall be subject to reduction by one-fifth as
further provided in this subdivision. Such work week reduction shall not
apply to essential officers and employees or to employees and officers
designated as managerial or confidential pursuant to article fourteen of
this chapter.
(b) For the purpose of this subdivision, "essential officers and
employees" shali mean any state employees of the executive branch who
serve in a position responsible for providing direct care or certain
security services as determined by the director of the budget to be
necessary for the preservation of public health or safety.
(c) The work week reduction shall _be scheduled during the period
commencing May tenth and ending May fourteenth, two thousand ten as
determined by the appointing authority of each agency in order to naxi~
mize the efficiency and effectiveness of the agency's operations. The
appointing authority shall ensure that every employee and every officer
who is not exempted pursuant to paragraph (a) of this subdivision is
scheduled for such work week reduction. Appointing authorities shall
not authorize additional overtime in comjunction with work week
reduct ions.
(4) In no event shall an officer or employee whose work week is
reduced pursuant to paragraph (a) of this subdivision be permitted to8

offset any reduction in wages or salary through the utilization of am
accrued leave credits.
§ 2. Section 200 of the state finance law is amended by adding a new
subdivision 2-c to read as follow:
2cc. Notwithstanding any other provisions of law, the wages and sala-
ries paid to employees whose work week was reduced pursuant to subdivi-
gion eight of section one hundred thirty-four of the civil service lay
shall be reduced by the same percentage reduction that was made to the
employee's work schedule during the relevant payroll period.
5 3. This act shall take effect inmediately, and shall expire and be
deemed repealed March 31, 2011.
