TWO NEW LAWSUITS ARE FILED BY DAW AUNG SAN SU KYI AND HER NLD PARTY
AGAINST THE MILITARY JUNTA LEADER SEN GEN THAN SHWE

Rangoon, April 29 - Faced with the ugly prospects of ceasing to be a political party
in one week time as the Article 25 of the Political Parties Registration Law provides
that any existing political party will be declared null and void if in case it fails to re-
register with the Union Elections Commission by May 6 this year, detained NLD
leader Daw Aung San Su Kyi this afternoon sought the help of Burma’s judiciary to
issue perpetual injunction to prevent the Union Elections Commission from
practicing this Law.

Accordingly, the NLD’s legal team headed by U Kyi Win this afternoon lodged Civil
Miscellaneous Application with the Supreme Court on behalf of Daw Aung San Su Kyi
under Section 5 ( A ) of judicial law and also under Section ( 45 ) of Specific Relief
Act appealing the Supreme Court to issue a declaratory decree for perpetual
injunction ( permanent ban ) of Article 25 of the Political Parties Registration Law
promulgated by the military junta on March 8 this year.

The Central Committee of the NLD on March 29 this year had declared that it would
not re-register with the Elections Commission on the grounds that the Electoral Laws
promulgated by the military junta were unjust and unfair.

Hence, the NLD is now facing abolishment on May 6 this year as the said Political
Parties Registration Law provides that all existing political parties must re-register
within 60 days or face abolishment.

The NLD legal team led by U Kyi Win this afternoon also lodged with the Supreme
Court a suit against the State Peace and Development Council ( SPDC ) in an effort
to appeal to the court to issue declaratory decree for recognizing NLD Chairman U
Aung Shwe and 25 others who won the 1990 general elections as legally elected
members of parliament and also to convene the parliament on the results of that
elections.

“The officials of the Supreme Court merely accepted my legal papers and asked me
to come back to the court at 1 pm tomorrow. In short the Supreme Court has not yet
accepted my suit and Civil Miscellaneous Application,” U Kyi Win told the press this
evening.

Explaining further, U Kyi Win said under Section 3 of the Pyithu Hluttaw Law
( Parliament Law ) promulgated in 1990 by the military government, clearly
stipulates that the parliament must be convened with those elected from 1990
general elections.

It should be recalled that the Union Elections Commission Law enacted on March 8
this year together with four remaining laws including Political Parties Registration
Law declared that the Multi-party General Elections Law under which 1990 general
elections was held was null and void.
