CONTRACT PROVISIONS FOR ARCHITECTS/ENGINEERS ANDCONSTRUCTION
The process for awarding contracts for architectural services forfacilities projects, and the construction contracts for such facilities aregoverned by Policy 4.23 Purchasing Authority and Procedures.When selecting an architectural and/or engineering firm to provideservices to the school system, the School Board may appoint a selectioncommittee to screen applicants and recommend the most qualified firms forthe desired projects. Such a committee will include members reflecting theeducational, financial and technical concerns of the school system and forthe particular project.In addition to procurement procedures, the Board requires that thecontract for construction includes specific language to permit control of thebehavior of the contractor's and subcontractors' employees. The contractorwill also be required to ensure that its employees are not listed on the sexoffender registry list for the jurisdiction where they live, as required byPolicy 5.16.Prior to awarding a contract for the provision of services that requirethe contractor or his employees to be in the presence of students duringregular school hours or during school-sponsored activities, the School Boardwill require the contractor and, when relevant, any employee who will havedirect contact with students, to provide written certification (1) that he/shehas not been convicted of a felony; (2) that he/she has not been convictedof any offense involving the sexual molestation or physical or sexual abuseor rape of a child, (3) whether he/she has been convicted of a crime of moralturpitude; and (4) that he/she is not currently required and will not berequired during the period of employment, to be registered on the sexoffender registry for the jurisdiction where he/she lives or any registry inVirginia.
