(1) I
N GENERAL
.—On March 2, 2010, the Sec-
8
retary of Defense issued a memorandum directing
9
the Comprehensive Review on the Implementation of
10
a Repeal of 10 U.S.C. § 654 (section 654 of title 10,
11
United States Code).

(2) O
BJECTIVES AND SCOPE OF REVIEW
.—The
13
Terms of Reference accompanying the Secretary’s
14
memorandum established the following objectives
15
and scope of the ordered review:
16
(A) Determine any impacts to military
17
readiness, military effectiveness and unit cohe-
18
sion, recruiting/retention, and family readiness
19
that may result from repeal of the law and rec-
20
ommend any actions that should be taken in
21
light of such impacts.

(B) Determine leadership, guidance, and

training on standards of conduct and new poli-
2
cies.
3
(C) Determine appropriate changes to ex-
4
isting policies and regulations, including but not
5
limited to issues regarding personnel manage-
6
ment, leadership and training, facilities, inves-
7
tigations, and benefits.
8
(D) Recommend appropriate changes (if
9
any) to the Uniform Code of Military Justice.
10
(E) Monitor and evaluate existing legisla-
11
tive proposals to repeal 10 U.S.C. § 654 and
12
proposals that may be introduced in the Con-
13
gress during the period of the review.
14
(F) Assure appropriate ways to monitor
15
the workforce climate and military effectiveness
16
that support successful follow-through on imple-
17
mentation.
18
(G) Evaluate the issues raised in ongoing
19
litigation involving 10 U.S.C. § 654.
20
(b) E
FFECTIVE
D
ATE
.—The amendments made by
21
subsection (f) shall take effect only on the date on which
22
the last of the following occurs:

(1) The Secretary of Defense has received the
1
report required by the memorandum of the Sec-
2
retary referred to in subsection (a).
3
(2) The President transmits to the congres-
4
sional defense committees a written certification,
5
signed by the President, the Secretary of Defense,
6
and the Chairman of the Joint Chiefs of Staff, stat-
7
ing each of the following:
8
(A) That the President, the Secretary of
9
Defense, and the Chairman of the Joint Chiefs
10
of Staff have considered the recommendations
11
contained in the report and the report’s pro-
12
posed plan of action.
13
(B) That the Department of Defense has
14
prepared the necessary policies and regulations
15
to exercise the discretion provided by the
16
amendments made by subsection (f).
17
(C) That the implementation of necessary
18
policies and regulations pursuant to the discre-
19
tion provided by the amendments made by sub-
20
section (f) is consistent with the standards of
21
military readiness, military effectiveness, unit
22
cohesion, and recruiting and retention of the
23
Armed Forces.
