SUBDIVISION REGULATIONS OF BRANTLEY COUNTY, GEORGIAINTENTAn Ordinance establishing minimum design standards for the subdividing of land intostreets, alleys and lots, defining certain terms used herein; providing for the method ofadministration and amendment; providing penalties for violation; repealing conflictingordinances; and for other purposes.ARTICLE I. SHORT TITLEThis Ordinance shall be known and may be cited as the "Subdivision Regulations ofBrantley County, Georgia".ARTICLE Il. AUTHORITY AND ENACTMENTArticle IX of The Constitution of the State of Georgia, 1976, grants authority to thegoverning body of each county and municipality to regulate subdivisions and landdevelopment. The Commissioners of Brantley County, pursuant to the authorityconferred above, do ordain and enact into law the following articles and sections.ARTICLE III. JURISDICTION AND APPLICATIONThe jurisdiction of this Ordinance shall apply to all that unincorporated area within theboundaries of Brantley County and these regulations shall apply (except asspecifically exempt herein) to the following forms of land subdivision:a) The division of land into two (2) or more parcels, lots or tracts; any part whichwhen subdivided shall contain less than three (3) acres in area, excluding burialplots in a cemetery.b) The dedication, vacation, reservation or improvement of any public or privateaccess easement or right-of-way through any tract of land regardless of thearea involved.ARTICLE IV. PURPOSESThe various articles and sections of the Ordinance are adopted for the followingpurposes, among others:a) To help conserve and protect the natural, economic, and scenic resources ofBrantley County.b) To help prevent and reduce the traffic congestion and traffic hazards whichresult from narrow or poorly aligned streets, and which result from excessiveentrance and exit points along major traffic arteries.c) To help eliminate the costly maintenance problems which develop whenstreets and lots are laid out without proper consideration being given to thedrainage characteristics of the tract of land at the time the land is beingsubdivided into streets and lots.d) To help prevent the spread of urban blight and slums.
