. Section 7 of chapter 4 of the General Laws, asappearing in the 2008 Official Edition, is hereby amended bystriking out clause Tenth and inserting in place thereof thefollowing clause:-
Tenth, “Illegal gaming,” any banking or percentage game played
with cards, dice, tiles, dominoes, or any electronic, electricalor mechanical device or machine for money, property, checks,credit or any representative of value, but excluding: (i) alottery game conducted by the state lottery commission, undersections 24, 24A and 27 of chapter 10; (ii) a game conductedunder chapter 23K; (iii) pari-mutuel wagering on horse races,whether live or simulcast, under chapter 128A and chapter 128C;(iv) the game of bingo conducted under chapter 271; and (v)charitable gaming, so called, conducted under chapter 271.
Section 48 of chapter 6 of the General Laws ishereby repealed.
Sections 64 and 65 of chapter 10 of the GeneralLaws are hereby repealed.
Chapter 12 of the General Laws is hereby amendedby inserting after section 11L the following section:-
Section 11M. (a) As used in this section the following wordsshall, unless the context clearly requires otherwise, have thefollowing meanings:-
“Board”, the Massachusetts gaming control board esta
blished inchapter 23K.
“Commission”, the Massachusetts gaming commission established
inchapter 23K.
“Division”, the division of gaming enforcement established
insubsection (b).
“Gaming establishment”, as defined in section 2 of chapter 23K.
(b) There shall be in the department of the attorney general adivision of gaming enforcement. The attorney general shalldesignate an assistant attorney general as director of thedivision. The director may appoint and remove, subject to theapproval of the attorney general, such expert, clerical or otherassistants as the work of the division may require.(c) The division shall enforce criminal violations of chapter23K.
The division’s powers and duties shall be as follows: (1)
investigate allegations of criminal activity related to orimpacting the operation of gaming establishments or games; (2)receive and take appropriate action on referrals for criminalprosecution from the commission or board; (3) provideassistance, upon request, to the commission and board in theconsideration and promulgation of rules and regulations; (4)
ensure that there is no duplication of duties andresponsibilities between it, the commission and the board; and(5) recommend persons to be placed on the list of excludedpersons maintained by the board.No employee of the division, or any person engaged by thedivision in the course of an investigation, other than those inthe performance of their official duties, shall place a wager inany gaming establishment licensed under chapter 23K during theperiod of
the employee’s
employment or assignment with thedivision.Officers and employees of the gaming enforcement unit ofthe state police assigned to the division shall record theirtime and submit total hours to the board. The board shallreimburse the state police.The attorney general shall be reimbursed by the board for thecosts of operating the division and legal representation of thecommission or board.
Chapter 12B of the General Laws is herebyrepealed.

chapter 6,” inserted by section 29 of chapter 4 of the acts of
