Dear Ms. Kimberlin:
On September 29, 2016, you submitted your Recipient Committee Campaign Statement
covering the period from July 1, 2016 through September 24, 2016. A review of the statement
has identified several items which are not in compliance with the City’s Campaign Contribution
Limitations in Municipal Elections ordinance [Fremont Municipal Code (FMC) Chapter 2.30]
and state law, The violations are detailed below.
Identification of Contributors. FMC Section 2.30.080 provides that the identification of
contributors is required whenever the cumulative contributions from a single source total
$100 or more during an election period. Government Code Section 84211 requires that
the campaign statement also include the contributor’s street address, occupation and
employer's name. There are several entries on your campaign statement regarding
contributors without the inclusion of their street address, occupation or employer's name.
Schedule E, Payments Made. For each payment of $100 or more made during the period,
report the name and street address, city, state, and zip code of the payee ot creditor, and
the amount paid during the period. Payments of less than $100 during the period are
reported as a lump sum on Line 2 of the Schedule E Summary. However, if two or more
payments under $100 were made for a single product or service and the total paid during,
the period was $100 or more, itemize the total amount paid during the period.
Code or Description of Payment: If one of the codes listed on Schedule E fully describes
the payment, enter the code. A full description of each code is provided on the back of
the Schedule E-Continuation Sheet. If none of the codes fully explains the payment, leave
the “Code” column blank and enter a brief description of the goods or services purch:
in the “Description of Payment” column.
Please correct the violations by submitting the additional contributor information, report
the name and street address, city, state, and zip code of the payee or creditor and description of
payment to the City Clerk’s Office in an amended campaign statement as soon as possible. A
contribution of $100 or more must be returned to the contributor within 60 days if the recipient
does not obtain the contributor’s address, occupation and employer.
