A Comparative Study on Probable Questions

Category-1: Top most important

1. (a) What do you mean by probation? Distinguish between probation and conditional
discharge. What is the effect of successful probation under the Probation of Offenders
Ordinance, 1960?
(b) How is probation officer appointed? What are the functions and duties of the
probation officer under the Probation of Offenders Rules, 1971?
(c) Distinguish between probation and parole as rehabilitative measures.
(d) What should be the principles and procedures for an ideal parole system is a
modern stat? Discuss. Do you think that parole is suitable for recidivists? Give
reasons for your answers.

2. (a) Do you think that the police system in Bangladesh is satisfactory in detecting
criminals and preventing crimes? What measures would you suggest for the
reformation of police system in Bangladesh?
(b) What should be the role of prisons in modern criminology? What measures would
you suggest for the reformation of the prison system in Bangladesh to serve the dual
purpose of preventive and reformative justice, simultaneously?

3. (a) What do you mean by ‘White Collar Crime’? What punishment do you suggest for
white-collar criminals? Should there be any difference between white-collar criminals
and ordinary criminals? Gove reasons for your answer.
(b) Do you consider that white collar criminals are relatively immune because of the
class bias of the courts and their power to influence the implementation and
administration of law? Give a brief account of the white collar criminality in
Bangladesh.
(c) Explain the concept of white collar crime as propounded by Sutherland. Is it really
a crime? Discuss.

4. (a) What is juvenile delinquency? Where the juvenile delinquency tried? Distinguish
between customary crime and juvenile crime. What are the causes behind juvenile
delinquency and what measures do you suggest to eliminate juvenile delinquency in
Bangladesh.
(b) What do you mean by juvenile justice? How does it differ from the formal
criminal justice system? ‘Punishment is for adult criminals, not for children’ –
discuss.
(c) Discuss the issue of the relevant date for judicial determination of the age of
juvenile delinquent with special reference to the leading cases: Bablu Vs. State, 1
BLD, 1981 (HC) 454, Bimal Das Vs. State, 46 DLR 1994 (HC) 460 and Mona Zillur
Rahman Vs. Sate, 23 BLD 2003 (AD) 187.
(d) What factors are to be taken into consideration in sentencing a juvenile
delinquent? Do you think that the recent trend of punishing juvenile delinquents is
compatible with the main purpose of juvenile justice legislation? Answer with special
reference to recent two cases: Munna and Others Vs. State, 7 BLC, 2002 (HC) 40 &
State Vs. Shukur Ali, 9 BLC 2004 (HC) 239.

5. (a) What is punishment? Explain in brief the different theories of punishment. Do


you think that through punishment a society without crime may establish? Discuss.
(b) ‘Punishment is no longer regarded as reformative or retributive, but is regarded as
rehabilitative’ – Discuss.
(c) What is the justification for abolition of capital punishment? If capital punishment
is abolished do you think that prison can serve as an effective method of social
control? Discuss.
(d) Do you consider the Penal Policy of Bangladesh satisfactory? Do you think
mandatory death penalty as provided in the Penal Code is violative of Articles 31, 32
and 35 of Bangladesh Constitution?

6. “Poverty is the root of all evils” – explain the statement from the Marxist point of
view. Is there any similar concept in Islam? How does industrialization act as a
contributing factor to the increase criminality?

7. What do you understand by organized crimes? On what principles organized crimes


are categorized? Write on different categories of organized crimes.

8. Discuss different theories of female criminality. Which theory can better explain why
female criminality is far less than that of a male? Do you think that there is a relation
between increasing rate of female criminality and women’s freedom?

Category-2: Important

1. What do you mean by criminology? Discuss the nature and scope of criminology. Do
you consider crime as an act which offends the basic sentiments of ‘Pity’ and
‘Probity’. How do you distinguish between crime and sin?

2. Discuss the contribution of psycho analysis to crime causation. What is Freud’s


theory of criminal behaviour?

3. What social factors do you thing are responsible for the development of criminal
behaviour in human personality? Why did Emile Durkheim consider ‘a society
without crime is not possible’?

4. Enumerate different schools of criminology with special reference to sociological


school of criminology? Distinguish between the classical school and positive school.

5. Do you think that crime is the price society pays for the possibility of progress? In
this connection give a brief account of ‘Anomie Theory’ and relate it to the
international situation of lawlessness.

Category-3: Less Important

1. Write Short Notes on:

a) Serial Killer.
b) Interrelationship between genetics and crime.
c) Chromosomal abnormality, hormonal imbalance and criminality.
d) Biological explanation of crime.
e) Challenges for lawyers and judges.
