Akron,OH 44308 CenterPlaza. It is understoodthat the City is working with the Coral Companyand the

This Proposalis beingsubmittedbasedon the conclusionsand recommendations of tlie


2006 PhaseI EnvironmentalSiteAssessrnent and the 2007LimitedPhaseII Environmental
Site Assessmentpefformedfor the referencedproperty. As noted in the PhaseI
EnvironmentalSiteAssessment (ESA), historicand adjacentlacility operationsposea
potentialimpactto soil and/orgroundwateron and beneaththe referencedproperty. The
potentialimpactsmay include,but arenot limitedto: petroleumand chlorinated solvent
compounds.The PhaseII ESA verifiedthat chlorinatedsolventsarepresentin the soil and
groundwaterat the propertybut the extentof the impactis not yet knorvn.

As indicatedduringvariouscommunications, the City wishesto progressin a staged


of the CedarCeuterPlazain preparationfor future
approacirto addressthe redevelopment
redevelopment.The CedarCenterPlazaconsistsof approximately140,000squarefeetof
building spaceand includesapproximately30 differentaddresses.

Specifically,the first phaseof tl-reprojectactivitiesr.villbe to perfomran inspectionof the


plazabuildingsfor asbestos-containing materials(ACMs) andpolychlorinated biphenyl
(PCB)-contained hydraulicfluids. This inspectionwill be perfomredprior to demolition
work. Next, additionalPhaseII environmentalsamplingr,villbe performedin orderto
comply with submissionof an Ohio VAP No FurlherAction (NFA) letter. It shouldbe
notedthat the first stepsof the PhaseII ProperlyAssessment were conrpletedunder
CCDOD funding. Moreover,thereare still a numberof unknorvnsubsurface conditions
with respectto soil andgroundwaterimpactsfrom historicaldry cleaningoperationson the
Propertythat havenot yet beeninvestigated.We proposeto usea smalldrilling rig rvhich
can accessthe interiorof the buildingswith at leasta l0-foot overheadclearance.This
drilling rig cannotinstalla 2-inchmonitoringr,vellbut can installa 1-inchpre-packedrvell.
Thesewells can be usedfor screeningpulposesonly and arenot acceptable underthe VAP.

We do not plan to installany l-inch rvellsat this time. Therefore,rvehaveprovidedan


estimateof the PhaseII ProperlyAssessment Scopeof Selices basedon our experience;
however,the extentof unknownsubsurface impactsmay requireadditionalsubsurface
investigations.

I. SCOPE OF SERVICES

Specifically,B&N i.villconrpletethe Scopeof Servicesidentifiedas follorvs:

t. Submitapproximately450 samplesfor analysisof ACM. Results


of the analyses will be listedby address, materialtype(i.e.,floor
tile, etc.),quantity,and an estimatefor remediationcosts.
Recommendations for properhandlingof the materialsrvill be
included. Roofingsamplesrvill alsobe obtainedand tested.The
roofing will be repairedrvith caulkingbut the roofing repairrvill
not be guaranteed againstftrfureleakingand rvill effectivelyvoid
any existingwananties.This Scopeof Serviceswill includethe
completionof asbestos testingto deterrninethe extentof ACM
present,its condition,and quantitiesthat will allow us to preparea
cost estimatefor abatement prior to demolition. B&N
acknowledges thatsomeunitsare still occupied;however,thiswill
not interferewith the processof obtainingall requiredasbestos
samples.Accessto all partsof all units is required. Reasonable
advancenotice(oneweek)rvill be given to site occupants;
however,the costestimateis basedon all sitework being
performedwithin the sametime frame. Additionalsitevisitsto
accommodate siteoccupantswill be bi1ledat an additionalcost.

2. At the requestof the Client,a surveyof othersuspecthazardous


materialsincludingpotentialmercury-containing fl uorescent
lamps,PCBscontaininglight ballasts,andpotentialleadbased
paintwill not be conducted.

3. One samplefrom eachof the hydraulicelevatorswill be obtained


and testedfor PCB containingoils.

4. A separate reportwill be providedincludingall of the above


that will includebudsetestimatesfor removalor
inforn-ration
remediationof ACM.

B. Perform SelectiveInterior EquipmentRemoval

1. Interiorpartitionsand droppedceilingsrvill be removedto allorv


interioraccessby a Geoprobe@ drilling machine.Any damageto
interiorstructuressuchas sprinklersystemswill not be the
responsibilityof B&N or the demolitioncontractor.It is
understoodthat the entire shoppingplazarvill be demolishedand
damaseto structuresand fixtures may and will occur. Carervill

be taken,but holesrvill be drilled throughthe floors and may be


requiredin the ceilings. Light fixtureswill be takendorvnand
placedinto anotherunit for properdisposalduring the exterior
demolition.

The City and/orthe Coral Companywiil be contactedprior to


hiring outsidelabor. If the City and/orCoral cannotmaketltese
servicesavailablepromptly,thenoutsidelaborrvill be hired.

C. Ohio VAP PhaseII Property Assessment

1. Notify Ohio Utility ProtectionService(OUPS)of our intentto


drill and engagea subcontractorto locateinteriorutilities,if
warranted.

2. A GroundPenetrating Radar(GPR) SLrrveyof the areabeliind


Blonder'sPaintStore will be performedto detemrinewhetheror
not tl-reundergroundstoragetank (UST) hasbeenremovedfronr
the Properly.

Advance20 additionalsoil borings,utilizing direct pusl-r


technology (i.e.,Geoprobe@), andcollectcontinuoussoil samples
to 20 feetbelow groundsurface(bgs)and/orfirst encountered
groundwater.Drilling at 13943145 cannotbe conductedat this
time due to the presenceof a basementbelow the former
(potential)dry cleaningbusiness.A core machinewill be usedto
drill throughthe concreteand a handaugerwill be usedto obtain
trvo shallow(up to 2 feet) samplesfrom beneaththe basement
floor. The proposedboring locationfigure shows l9 locations;an
additionalboringwill be placedas siteconditionsdictate.

T. Screeneach2-foot intervalof soil for volatileorganiccompounds
(VOCs) usinga photoionizationdetector(PID). A minimumof
two and up to four soil samplesfrom eachboring willbe analyzed
basedon PID readings, and/orproximityto
discolorations,
groundwater.

Submitup to 50 soil samples(i.e.,includesfour duplicate


samples)and i0 groundwatersamples(i.e.,includesone
duplicate)to BelmontLaboratoriesfor analysis.Specificanalyses
will includetotal petroleumhydrocarbons (TPH), includingtire
TPH gasolinerangeand dieselrangeorganics(GRO and DRO)
usingEPA Method8015;polynuclear aromatichydrocarbons
(PAHs) by EPA Method 8270; 15 Ohio EPA VAP metalsby EPA
Method6000/7000series;and VOCs by EPA Method 8260. One
compositesoil sampleand one compositepurgedwatersample
rvill be collected and analyzedfor drummed investigativelvaste
disposalcharacteristics.

II. SCHEDULE

The asbestossurveywill be initiatedwithin 2 weeksof a signedcontractdependentupon


personnelavaiiabilityand buildingaccess.Samplingshould take 1
approximately r'veek
and the completedreportwill be prepared3 rveeksafter sarnpleshavebeenobtained.

The PhaseII PropertyAssessment field activitiesr.vi1lcommencewith clearingof utilities


and conductingthe GPR Survey. Snorvcoverwill hinderthe GPR surveyand may detract
fron-rthe ability of the radarto detectburiedmetalobjects. Any removalof interior
partitionsor possibleACMs will be conductedafterthe resultsof the asbestos surveyhave
beenreceived.

The expecteddurationof the Ol'rioVAP PhaseII activitiesthroughcompletionof an NFA


letteris approximately250 days,assumingno delaysin siteaccessibiliry.

TII. PROFESSIONALFEES

B&N rvill providethe servicesoutlinedaboveon an hourly ratebasisplus reimbursable


expensesfor the follorvingnot-to-exceedfees. Reimbursable expensesare definedas
reasonable out-of-pocket costsattnbutableto servicessuch as travel,subsistence,
technologycharges,and reprodr-rction(Attachments 1 and 2).

B&N acknowledges that paymentfor work performedwill be madeafter fundinghasbeen


receivedfrom the CCDOD; however,the City is responsiblefor paymentin full of all fees

VI. STANDARDOF PERFORNIANCE

A. ProfessionalServices

B&N shallperformits servicesin accordance with the standards for such


professionalserviceswl-richprevailin the areain rvhich,and at the time
that,thoseservicesarerendered.No rvananty,gtlarantee, or
eitherexpressor implied,is includedor intendedin any
representation,
designs,repofis,or otherservicesprovided
materials,plans,specifications,
by B&N.

B. Insurance

The insurancemaintainedbv B&N is summarizedbelow:

t. B&N shallconrplywith all Workers'Compensation laws and,if


required,providecertificatesof coveragein connectionlvith this
Agreement.

2. During the term of this AgreementB&N will maintainin full force


and effectthe following insurancecoveragesand will provideto
the City certificatesconfirmingsuchcoverage,Llponrequest:
