S.O.1456 (E)- Whereas certain modifications which theCentral Government proposed to make in the Master Plan forDelhi 2001, were published in the Gazette of India,Extraordinary as public notice vide S.O. No. 1161 (E) dated21
July 2006, by the Delhi Development Authority inaccordance with the provisions of section 44 of the DelhiDevelopment Act 1957 (61 of 1957) inviting objections andsuggestions as required under sub-section (3) of Section 11 Aof the said Act , within thirty days from the date of the saidnotice;2. Whereas the objections and suggestions received withregard to the proposed modifications were considered by aBoard of Inquiry duly constituted by Delhi DevelopmentAuthority under the relevant rules, and the Authority, afterconsidering the report of the said Board, has recommendedthe modification of the Master Plan of Delhi 2001 as envisagedin the said public notice, with certain changes;
3. And Whereas the Central Government has, aftercarefully considering all relevant aspects of the matter,decided to modify the Master Plan for Delhi 2001;4. Now, therefore, in exercise of the powers conferredby sub-section (2) of Section 11 A of the said Act, the CentralGovernment hereby makes the following modifications in thesaid Master Plan for Delhi 2001 with effect from the date of Publication of this Notification in the Gazette of India.
In Gazette of India, Part II, section 3, sub-section(ii) dated 1.8.1990 the following shall be incorporated:-(i) On page 165(RHS) under CLAUSE 10.0 MIXED USEREGULATIONS the existing provisions, as modified videnotification S.O. No. 425(E) dated 28.3.2006 shall besubstituted by the following:-
This chapter covers the policy for mixed use of land forcertain permissible purposes. The policy acknowledges theneed for permitting use of land for purposes other than thatfor which it was originally envisaged and lays down theconditions under which this may be applied in differentsituations. The general procedure to be followed forimplementation of the said policy, and mitigating measures tobe taken to counter the effect of such non-intended use insuch areas are also described.
i. Mixed use for the purposes of this Chapter means theprovision for non-residential activity in residentialpremises.ii. The policy aims to balance the socio-economic need forsuch activity and the environmental impact of the saidactivity in residential areas.iii. Mixed use allows access to commercial activities in theproximity of the residences and reduces the need forcommuting across zones in the city. However at thesame time, it needs to be regulated in order to manageand mitigate the associated adverse impact related tocongestion, increased traffic and increased pressure oncivic amenities.iv. The over-riding principles for permitting mixed use arethe need to acknowledge and make adequate provisionfor meeting community needs, mitigating environmentalimpact and providing for safe and convenient circulationand parking.v. Mixed-use shall not be permitted in the LutyensBungalow Zone, Civil Lines, Government housing,institutional and staff housing of public and privateagencies and buildings/precincts listed by the HeritageConservation Committee.
