. Two sets of parents, whosereligious beliefs are offended by gay marriage and homosexuality,sued the Lexington, Massachusetts school district in which theiryoung children are enrolled. They assert that they must be givenprior notice by the school and the opportunity to exempt theiryoung children from exposure to books they find religiouslyrepugnant. Plaintiffs asserted violations of their own and theirchildren's rights under the Free Exercise Clause and theirsubstantive parental and privacy due process rights under the U.S.Constitution.The Parkers object to their child being presented inkindergarten and first grade with two books that portray diversefamilies, including families in which both parents are of the samegender. The Wirthlins object to a second-grade teacher's readingto their son's class a book that depicts and celebrates a gaymarriage. The parents do not challenge the use of these books aspart of a nondiscrimination curriculum in the public schools, butchallenge the school district's refusal to provide them with priornotice and to allow for exemption from such instruction. They askfor relief until their children are in seventh grade.Massachusetts does have a statute that requires parentsbe given notice and the opportunity to exempt their children fromcurriculum which primarily involves human sexual education or humansexuality issues.
