Dear Representative McDermott:

We, the undersigned, are writing to express our support of H. Con Res.290, designating
June 30th as “National ESIGN Day.”

The Electronic Signatures in Global and National Commerce Act (ESIGN), Pub. L. No.
106-229, 114 Stat. 464 (2000) (codified at 15 U.S.C. § 7001 et seq.) was enacted on June
30, 2000, to ensure that a signature, contract, or other record relating to a transaction may
not be denied legal effect, validity, or enforceability solely because it is in electronic
form. June 30, 2010 marks the 10th anniversary of the enactment of ESIGN.

Based on ESIGN, companies are implementing full scale solutions in multiple sectors,
and are realizing the benefits of electronic transactions. These benefits include:

 Improved Customer Satisfaction: Consumer gains in terms of ease of use,


convenience, transaction speed, reduced costs and customer experience.
 Velocity: Significantly increased transaction speed and closure rates, saving time
and money for businesses.
 Transparency: Parties to the transaction are able to see the transaction
progressing in real-time, reducing transaction “breakage.”
 Reduced Transaction Costs: Savings result from reduced need to re-key
information and store contracts in paper at a physical locale.
 Accuracy: Assured, predictable outcomes with fewer errors and faster error
detection and corrections.
 Compliance: Process management “built in” to transactions, so that required
disclosures, storage retention times, and notifications can be executed
programmatically, and not forgotten.
 Reduction of Business “Carbon Footprint:” Eliminating the need to produce,
process, transport, maintain, destroy or dispose of paper transaction
documents.

H. Con. Res. 290 recognizes the previous contribution made by the Congress to the
adoption of modern solutions that keep our nation on the leading technological edge; and
reaffirms the Congress’s commitment to facilitating interstate and foreign commerce in
an increasingly digital world.
