February 21, 2003BULLETIN NO. 03-02TO THE HEADS OF EXECUTIVE DEPARTMENTS AND AGENCIESSUBJECT: Across-the-Board Rescission in H.J. Res. 2Purpose. This bulletin provides guidance on the rescission required by section 601 of theMiscellaneous Appropriations Act, 2003 as contained in the Consolidated AppropriationsResolution, 2003 (H.J. Res. 2).Background and coverage. Section 601 in Division N of H.J. Res. 2 (Attachment A) rescinds anamount equal to 0.65 percent of:(1) the budget authority provided (or obligation limitation imposed) for fiscal year 2003 forany discretionary account in divisions A through K of H.J. Res. 2;(2) the budget authority provided in any advance appropriation for fiscal year 2003 for anydiscretionary account in any prior fiscal year appropriations Act; and,(3) the contract authority provided in fiscal year 2003 for any program subject to limitationcontained in H.J. Res. 2.H.J. Res. 2 explicitly states that rescissions must be made proportionately to each program,project, and activity within each account. It also provides exemptions for specific programs.Required actions. Agencies are required to submit their proposed rescission by Treasuryappropriation fund symbol, type of budgetary resource, and the rescission amounts using theelectronic format provided in Attachment B. To assist agencies, Treasury, and OMB inimplementing and monitoring this rescission, Attachment B consolidates information previouslyrequested to implement such rescissions and consequently requires agencies to provide moredetailed information to OMB than they have for past rescissions. Agencies must also provideany additional supporting information requested by their Resource Management Offices. Allmaterial must be sent to the agency’s OMB representative by Friday, February 28.
 
Once OMB notifies agencies that it concurs with the proposed rescissions, then agencies shouldreflect the rescissions in their FY 2003 reapportionments, which are due to OMB by Friday,March 7. While OMB Circular A-11 requires agencies to submit re-apportionments within 10days of enactment, we have pushed out the due date an additional five days, which is the latestdue date allowable by law.Attachments C and D provide detailed guidance for budget and accounting offices to execute andreport this rescission.Contact. --Attachment AACROSS-THE-BOARD RESCISSIONSSec. 601(a) Across-the-Board Rescission. --There is hereby rescinded an amount equal to 0.65percent of (1) the budget authority provided (or obligation limitation imposed) for fiscal year 2003 forany discretionary account in divisions A through K of this joint resolution;(2) the budget authority provided in any advance appropriation for fiscal year 2003 for anydiscretionary account in any prior fiscal year appropriations Act; and,(3) the contract authority provided in fiscal year 2003 for any program subject to limitationcontained in this joint resolution.(b) Proportionate Application. --Any rescission made by subsection (a) shall be appliedproportionately-(1) to each discretionary account and each item of budget authority described in subsection(a); and(2) within each such account and item, to each program, project, and activity (with programs,projects and activities as delineated in the appropriation Act or accompanying reports for therelevant fiscal year covering such account or item, or for accounts and items not included inappropriation Acts, as delineated in the most recently submitted President's budget).(c) The rescission in subsection (a) shall not apply to budget authority appropriated or otherwisemade available by this joint resolution in the following amounts in the following activities oraccounts:$4,696,000,000 provided for the Special Supplemental Nutrition Program for Women,Infants, and Children (WIC) in the Department of Agriculture in division A;$6,667,533,000 provided for the Head Start Act in the Department of Education indivision G; [While this is how it appears in the actual appropriations language, Head Startis still part of HHS, not Education.]$23,889,304,000 provided for medical care in the Department of Veterans Affairs indivision K; and$3,836,000,000 provided for the Shuttle program in the National Aeronautics and SpaceAdministration in division K.
