MOTION TO EXCCED PAGE LIMIT BY ONE PAGE

Now comes Plaintiff Brett Kimberlin and moves this Court to allow him to exceed

the page limit of his Supplemental Response by one page consisting of the

Conclusion and the Certificate of Service.

1. This Court's April 20,2017 Order set a ten page limit for the party's

Supplemental Responses. Defendant Frey's response included approximately 400

pages of exhibits.

2. Plaintiff therefore had to respond not only to this Court's Order on causation,

but also to Defendant's response.

3. Plaintiff contacted counsel for Defendant Frey and asked for their consent to

exceed the page limit by one page. On May 15, 2017, counsel responded that they

had "no objection" to Plaintiffs request to file an eleven-page response.

4. The eleventh page of the response consists of two thirds ofa page filled

almost entirely with the Conclusion and the Certificate of Service.

Wherefore, Plaintiff moves this Court to accept the eleven-page Supplemental

Response.
