CORRECTIONS: Authorizes offenders convicted of certain drug crimes to be eligible for


work release programs

1 AN ACT

2 To amend and reenact R.S. 15:711(G) and 1135(D), relative to work release programs; to

3 expand eligibility requirements for a certain class of inmates to participate in a work

4 release program; and to provide for related matters.

5 Be it enacted by the Legislature of Louisiana:

6 Section 1. R.S. 15:711(G) and 1135(D) are hereby amended and reenacted to read

7 as follows:

8 §711. Work release program

10 G. Notwithstanding the provisions of Subsection B above of this Section or

11 any other law to the contrary, any inmate who has been convicted for first degree

12 murder (R.S. 14:30), second degree murder (R.S. 14:30.1), aggravated rape (R.S.

13 14:42), attempted aggravated rape (R.S. 14:27, 14:42), forcible rape (R.S. 14:42.1),

14 aggravated kidnapping (R.S. 14:44), aggravated arson (R.S. 14:51), armed robbery

15 (R.S. 14:64), attempted murder (R.S. 14:27, 14:29), attempted armed robbery (R.S.

16 14:27, 14:64), producing, manufacturing, distributing, or dispensing or possession

17 with intent to produce, manufacture, distribute, or dispense a controlled dangerous

18 substance classified in Schedule I or Schedule II of R.S. 40:964, and persons

19 sentenced as habitual offenders under R.S. 15:529.1 shall be prohibited from

20 participation in a work release program except during the last six months of their

1 terms. In addition, no inmate who has been convicted of producing, manufacturing,

2 distributing, or dispensing or possession with intent to produce, manufacture,

3 distribute, or dispense a controlled dangerous substance classified in Schedule I or

4 Schedule II of R.S. 40:964, except any person convicted of distribution or possession

5 with intent to distribute cocaine where the offense of conviction involves less than

6 twenty-eight grams of cocaine or any person convicted of distribution or possession

7 with intent to distribute marijuana where the offense of conviction involves less than

8 one pound of marijuana shall be prohibited from participation in the work release

9 program except during the last six months of their terms.

13 D. Any inmate who has been convicted of first degree murder (R.S. 14:30),

14 second degree murder (R.S. 14:30.1), aggravated rape (R.S. 14:42), attempted

15 aggravated rape (R.S. 14:27, 14:42), forcible rape (R.S. 14:42.1), aggravated

16 kidnapping (R.S. 14:44), aggravated arson (R.S. 14:51), armed robbery (R.S. 14:64),

17 attempted murder (R.S. 14:27, 14:29), attempted armed robbery (R.S. 14:27, 14:64),

18 producing, manufacturing, distributing, or dispensing or possession with intent to

19 produce, manufacture, distribute, or dispense a controlled dangerous substance

20 classified in Schedule I or Schedule II of R.S. 40:964 and persons sentenced as

21 habitual offenders under R.S. 15:529.1 shall be prohibited from participation in the

22 work release program except during the last six months of their terms. In addition,

23 no inmate who has been convicted of producing, manufacturing, distributing, or

24 dispensing or possession with intent to produce, manufacture, distribute, or dispense

25 a controlled dangerous substance classified in Schedule I or Schedule II of R.S.

26 40:964, except any person convicted of distribution or possession with intent to

27 distribute cocaine where the offense of conviction involves less than twenty-eight

28 grams of cocaine or any person convicted of distribution or possession with intent

29 to distribute marijuana where the offense of conviction involves less than one pound

Abstract: Authorizes offenders convicted of possession with intent to distribute certain


amounts of cocaine or marijuana to participate in work release programs.

Present law authorizes inmates under the jurisdiction of the sheriffs of each parish and
inmates of a community rehabilitation center operated by DPS&C to participate in a work
release program except that any inmate who has been convicted of first degree murder (R.S.
14:30), second degree murder (R.S. 14:30.1), aggravated rape (R.S. 14:42), attempted
aggravated rape (R.S. 14:27, 42), forcible rape (R.S. 14:42.1), aggravated kidnapping (R.S.
14:44), aggravated arson (R.S. 14:51), armed robbery (R.S. 14:64), attempted murder (R.S.
14:27, 29), attempted armed robbery (R.S. 14:27, 64), producing, manufacturing,
distributing, or dispensing or possession with intent to produce, manufacture, distribute, or
dispense a controlled dangerous substance classified in Schedule I or Schedule II of R.S.
40:964, and persons sentenced as habitual offenders under R.S. 15:529.1 are prohibited from
participation in the work release program except during the last six months of their terms.

Proposed law creates an exception for any person convicted of distribution or possession
with intent to distribute cocaine where the offense of conviction involves less than 28 grams
of cocaine or any person convicted of distribution or possession with intent to distribute
marijuana where the offense of conviction involves less than one pound of marijuana by
allowing them to participate in the work release program and otherwise retains the
provisions of present law.
