I'm writing to update you on the status of your charter application and to
describe your next steps as we proceed towards authorization.
On Monday, August 9, the Chancellor submitted a letter of intent to
apply to the Regents on your behalf. The amendments to the charter
law are clear that the support of the local district must be a strong factor
in the Regents' authorizing decisions and with the Chancellor's backing,
your application will receive favorable consideration from the Regents.
The next steps for your application will fall along the Regents'
authorizing timeline, copied below. At this time you should create a
Prospectus, per the guidance issued by the State Education
Department in their charter application. Please return your Prospectus
document to me by 9am, Monday, August 16. We will review and submit
to the SED on your behalf.
Note that the Executive Summary you submitted to this office should
contain all of the requested information for the Prospectus and that you
should be able to satisfy the Prospectus request by reformatting your
existing Executive Summary.
The SED will review your Prospectus and make a decision about
whether to invite you to submit a full application per the SED's recently
released application format. Like the Prospectus, we are confident that
your existing application will only need to be reformatted, rather than
recreated, but it would be prudent to look through the SED's application
kit (available here:http://www.emsc.nysed.gov/psc/startcharter.html) and
begin to think about what you'll need to do.

Evaluation Criteria:
A response that meets the standard will
· demonstrate understanding of the target population;
· present a plan for attracting, serving, and retaining such students
in numbers that are comparable to that or greater than the existing
school district;
[1] As required by the 2010 revisions to the Charter Schools Act, the
Board of Regents and the SUNY Trustees will adopt appropriate and
responsible enrollment and retention targets for students with
disabilities, English language learners, and students who are eligible for
free and reduced priced lunch for new public charter schools created
under the 2010 cap. These targets will be incorporated into new public
charter school's performance plans, will be part of annual reporting, and
will be a piece of evidence that the Board of Regents considers when
considering to renew the charter of a school. Staff in the Department's
Office of Innovative School Models, in collaboration with SUNY's
Charter Schools Institute, will work to propose these targets to their
respective governing boards for consideration before new charter
awards are made by the Board of Regents at their regularly scheduled
December 2010 meeting.
