Thecourt ook the matterundersubmissionn August 2,2010.Afterdueconsideration and based upon thepapersfiledby thepartiesandoralargument,orgoodcauseshown, he Courtmakeshe following rulings and ORDERS:1.Petitioner's request for DeclaratoryRelief is GRANTED as to theUniversityand DENIEDas tothe Foundation.This Court declares that the Universityviolated theCaliforniaPublic RecordsAct in that:(a)University is a stateagencyor state body within the meaning of GovernmentCodeS6252(a);(b)Petitionermadeapublicrecordsrequeston March31,2010(the"Request"),for"allUniversity records, other than those specificallypreparedorpublic release,concerning heplannedappearancefex-GovernorSarahPalinasguestofhonorattheUniversity's50ft AnniversaryGala on June25,2010";(c)On April6,2070, Gina B. Leguria respondedtotheRequeston behalf ofUniversityby statingthat,"TheUniversity has nodocuments hrtare esponsivetoyourrequest;" and thatthe requestwould be referred o theFoundation;(d)Petitioner CaliforniansAwareattemptedo clarify theresponseo the Requestand to determinewhethertheUniversitv actuallvhad documentsthatwereresponsive o the Request.
