Water Charges Staff profile
As of July 2010, Lessors are able to pass full water consumption onto tenants.However, lessors are only allowed to pass on the full water consumption costs totenants if the rental premises are individually metered, the tenants agreementstates the tenant must pay for water consumption and the rental premises iswater efficient. For the property to be water efficient it will need to meet therequirements including the standards for a three star WELS rating or higher.These requirements are:
a maximum flow rate of nine litres per minute for showerheads, internalcold water taps and single mixer taps (excluding taps for bathtubs andappliances); and
dual flush toilets using less than 6.5 litres on full flush, 3.5 litres on halfflush and 4 litres for the average flush volume (based on the average ofone full flush and four half flushes).If your premises are individually metered but not water efficient, and theagreement states the tenant must pay for water, the lessor must pay for areasonable amount of water. An agreement upon what is a reasonable amountmust be made at the start of the tenancy and include the amount as a specialterm in the tenancy agreement.The current level of restrictions for SEQ can be found on the Queensland WaterCommission (QWC) website or by contacting the local council or council-ownedwater supplier.
