Indian Trust Act 1882

Section 3 defines A Trust


as : A "trust" is an
obligation annexed to
the ownership of
property, and arising out
of a confidence reposed
in and accepted by the
owner, or declared and
accepted by him, for the
benefit of another, or of
another and the owner
What is a Trust?

•Agreement between a person, called


author of the trust who transfers
something of value, called an asset, to
another person, called a trustee.

•The trustee then manages and controls


this asset for the benefit of a third
person, called a beneficiary.

Difference between Trust and Bailment

•Trustee becomes the full owner of the property, but the


bailee has a special property only (for the time being).

•Bailee has legal obligation, but the trustee has equitable


obligation

•Trust maybe for any property, but bailment can be for


only movable property.
