Environmental activists will have to answer in a court of law, where


conjecture and hearsay are not admissible, says J EF FREY L O WES ,
who Tuesday [ January 26 t h , 2010 ] filed 115 charges against 23
individuals, groups and the P ROV I NCE OF O NT AR IO , for its ban on
the use of cosmetic pesticides.

He claims that the province’s legislation, enacted last year, is based


on fraudulent information as far as the health and environmental
risks associated with the use of chemicals to maintain lawns and
landscapes, is concerned.

L OWE S is guest speaker at the I NT EGRATED E N-


V IRO NMENT AL P LA NT M A NAGEME N T A S SOC IA-
T IO N ’s 14th annual conference being held in
K ELOW NA [ British Columbia ] this week.

K ELOW NA enacted a similar bylaw last year,


and L OWE S said he will be investigating the ba-
sis of that legislation as well.
The crux of it is whether there is an issue or whether there is just
the perception of an issue, he explained.

“ If legislation is enacted based on extensive testing, field trials,


toxicology and epidemiology, that’s one thing, but if it’s based on
medical reports supplied by environmental activists — or on a
public opinion poll — that’s another ”, he said. “ We’re not
questioning the authority of a mu nicipality to enact a bylaw, but
they need justification, ” he said.

T ODD C ASH IN and M ICHELLE K AM from the C IT Y OF K ELO WN A said


the city’s bylaw was the result of a grassroots movement’s concerns
about pesticide use. [ W rong ! ]

Cashin is a so–called environmental technologist, and


Kam is a mere watershed coordinator. Both Enviro–
Maniacs have ties to the Environmental–Terror–Mo-
vement, and used their positions to conspire to prohibit
FEDERALLY LEGAL, SCIENTIFICALLY SAFE, and TO-
TALLY IRREPLACEABLE pest control products in the
City of Kelowna. The so–called « grassroots move-
ment » that led to Kelowna prohibition actually con-
sisted of a small group of their maniac friends.

Both Cashin and Kam have NO recognized expertise,


training, or background, in matters concerning PEST
CONTROL PRODUCTS, TURF MAINTENANCE, or the
GREEN SPACE INDUSTRY ! Overall, the opinions ori-
ginating from Cashin and Kam on these matters are
VALUELESS and W ORTHLESS.
K AM pointed out it only affects non–essential pesticides; those used
for esthetic [ sic ] purposes.

“ We have no concerns, ” commented C A SH IN . C A SH IN said the


city hasn’t had to enforce the city’s new bylaw yet.

L LOYD M AN CHESTER of C A NA D IAN E ARTH C ARE in K ELO WN A , which


was active in promoting the bylaw, said, “ The case on pesticides
is well known and the province has the right to ban any pesticide
it so desires. ” [ W rong ! ]

“ His ( Lowes’ ) actions do not concern me and are likely funded


by the pro–pesticide industry. ” [ This response is t ypical En-
viro–Maniac paranoid delusions and conspiracy theories. ]

Despite the fact that it calls itself Canadian EarthCare,


it is simply a little alternative–life–style club with En-
viro–Maniacs that crave some fame, celebrity, mone y,
and a bit of power. Formerly had the cutesy title of
C.O.M.A., an acron ym for Citizens Opposed to Mala-
thion Applications. ( Comatose Enviro–Maniacs ? ─
W ho knew ? ) It has an alliance with Okanagan W ild-
life Recovery Centre ( O.W .R.C. ). NOT A SINGLE
MANIAC within Canadian EarthCare has ANY recog-
nized expertise, training, or background, in matters
concerning PEST CONTROL PRODUCTS, TURF MAIN-
TENANCE, or the GREEN SPACE INDUSTRY ! Over-
all, the opinions originating from this little club of ma-
niacs are VALUELESS and W ORTHLESS.
L OWE S also plans a submission to the P ROVINCE OF B R IT ISH C O-
LUMBIA , which is proposing a similar ban on pesticides used for
cosmetic purposes.

It concludes its public consultation period F EBRUARY 15 [ 2010 ]


on the proposed new legislation.

“ The lawn care industry is being told to lower their standards; to


use less effective products to do their job, ” L O WE S said.

“ And, the industry is losing customers, ” he said, while turf is be-


coming infested with weeds and insects.

By banning useful products for use by the lawn care industry, its
members are prevented from properly maintaining sports fields,
parks, rights–of–ways, and other landscapes, he said.

It has cost the industry 30 per cent of its business, or $350 million
in O NTAR IO , he claims.

“ We’re assessing the monetary damage done to the industry


now and will sue to recover, ” he commented.

L OWE S admits he has no background as a pesticide applicator or a


scientist, and says there’s nothing personal about this campaign
against such bans on pesticide use.

He said he is not representing chemical companies.

He was asked to help out a group of lawn care companies in K ING-


STO N , O NTAR IO and it grew from there.
Although he filed the charges personally, there is a F EBRUAR Y 17
[ 2010 ] hearing with the Crown prosecutor and a judge to set a
date for a PRE – ENQUETE hearing on the charges.

That will result in a decision on whether the Crown will proceed


with the charges under the C R IM IN AL C ODE OF C AN AD A .

Allegations include that false and misleading information regarding


the health and environmental risks of pesticide products regulated
by the federal government influenced the decision to ban pesticides
for cosmetic use in Ontario.

As well, activists pretended to use « PEER – REVIEW ED STUDIES » and


endorsements by the C AN AD IA N P E D IA TR IC S OC IET Y to defraud the
lawn care industry of access to products; and impeded access to
H EALTH C ANA DA –approved pesticides by fraud, which directly af-
fected the O NT AR IO lawn industry’s $1.3 billion market, he alleges.

Since 45 per cent of cancers can be prevented, a


toxicology professor from the school of environ-
mental sciences at the U N IVERS I TY OF G UELPH
suggests society begin with that, rather than en-
acting pesticide bans when there is no scientific
basis for concern.

Tobacco use is the cause of cancer in 30 per cent of men and 20


per cent of women, while sunlight, drugs, viral infections, carcino-
gens in the workplace and obesity are other known causes of cancer
that we can take action on to prevent deaths.
“ All of that matters far more than pesticides
in cancer prevention, ” he commented, adding
that pesticides aren’t even on the list. Yet,
C ANA D IAN C A NCER S OC IET Y does not support
the use of ornamental pesticides, based on in-
accurate information, he said.

H EALTH C AN AD A on toxicity testing of pesticides.

He emphasized he does not work for C ANAD IA N C ANCER S OC IETY ,


nor for the IEPMA [ Integrated Environmental Plant Management
Association of W estern Canada ].

He said the European community based its regulations on pesti-


cides on a scientific report that contains arithmetic errors and
made–up assumptions.

“ All the data was made up, ” he concluded, referring to material


from M ARK B LA INEY ’s report to the E UROPEAN P ARL IAME NT ’ S C OM-
MITTEE ON THE E N V IR ONME NT , P UBLIC H EALTH AN D F OOD S A FET Y .

He said no one disagrees with such common sense cautions as


avoiding the use of pesticides that are known to be carcinogenic
around playgrounds, for instance, but he said regulations on the
use of pesticides must be based on sound science.

Kelowna homeowners have embraced a new bylaw that restricts the


use of pesticides on lawns, city council will hear on Monday.

Yeah right ! In fact, homeowners in Kelowna were


COERCED into accepting a NEEDLESS, SENSELESS,
and MALICIOUS prohibition of FEDERALLY LEGAL,
SCIENTIFICALLY SAFE, and TOTALLY IRREPLACE-
ABLE pest control products.

Nearly 80 per cent of residents are aware of the bylaw, and more
than two–thirds of those say they‘ve eliminated or reduced their
pesticide use, according to staff who conducted a telephone survey
last fall. [ Big deal ! ]
“ With continued public education, the numbers of pesticide us-
ers should be further reduced, ” reads part of a report to council
by staffer T ODD C ASH IN .

K ELOWNA ‘s bylaw, which came into effect last year [ 2009 ] , pre-
vents homeowners from using products such as Weed ‘N Feed on
their lawns. While there were said to be hundreds of calls to the
city about the bylaw, only five complaints were made by people
about their neighbours supposedly using pesticides.

“ All complaints were followed up by city staff, information was


provided and an educational package was sent to residents, ”
C ASH IN writes, although his report does not indicate whether any-
one suspected of using pesticides was fined.

One homeowner asked for an exemption to use pesticides, but this


request was denied.

Critics, whose ranks include the owners of lawn–and–garden–care


companies, say there‘s no scientific evidence that the pesticides are
harmful, and note the products have all been approved for sale and
use by the federal government.

At a meeting in Kelowna last week of owners of lawn–and–garden–


care companies, there were calls for Ottawa to stand up to the “bul-
lies” in the environmental movement who have lobbied for pesticide
bans in the absence of studies that show the products are harmful.

Kelowna‘s bylaw allows licensed commercial applicators to continue


using pesticide products. However, one « ALTERNATE RECOMMENDA-
TION » to be presented on Monday [ February 8th, 2010 ] would
also ban them from using pesticides in favour of products said to be
more friendly to the environment.

Beginning in 2009, the City of Kelowna will regulate the use of pesticides for non–essential purposes by
home owners on all residential properties. Non–essential purpose includes maintenance of outdoor trees,
shrubs, flowers, lawn and other ornamental plants and hard surfaces such as driveways.

What are pesticides?


Pesticides are defined as chemical products used to control unwantedweeds, insects and other organ-
isms and include insecticides, herbicides, fungicides and rodenticides, as well as weed and feed type
products.

Exemptions from the Bylaw

The following are exempt the bylaw


• Certified pesticide applicators
• Noxious weeds and insects
• Fruit and vegetable gardens
• Agricultural land and farms
• Greenhouses
How to choose the right products?

Read the guarantee on the label of the pesticide bottle. The guarantee states the active ingredient(s)
in the product, which controls the pest.

Excluded pesticides ALLOWED under the bylaw

• Acetic acid
• Bt (Bacillus thuringiensis)
• Borax
• Corn gluten meal
• Dormant or horticultural oil
• Fatty acids
• Ferric or ferrous phosphates
• Mineral oil
• Pyrethrum or pyrethrins
• Silicon dioxide (diatomaceous earth)
• Soap
• Sulphur (lime sulphur and other sulphur compounds)

Offenses and Penalties


A person who commits an offence is liable to a minimum fine of$500 and a maximum fine of $10,000

Pesticides don’t just kill pests. Birds, bees and other beneficial creatures
are also affected. And speaking of birds and bees, some studies suggest a
link between pesticide use and h human health. [ W rong ! W rong ! ]
