The Bill seeks, amongst other things, to impose a duty on the heads of all Federal ministries, parastatals, corporations, departments, commissions, agencies, institutions or any government establishment to “post in three conspicuous places of their offices for a period of one month a complete list of all existing vacant positions in their respective offices which are to be filled” and “to transmit a copy of such list and the corresponding qualification standards to the Federal Civil Service Commission not later than the tenth day of every month.” (Section 2 of the Bill). It is sponsored by Senator Gbemi Saraki (Kwara Central, Nigeria)

Existing Vacancies (Publication) Bill, 2005.An Act Requiring Publication of Existing Vacant Position in FederalGovernment Offices to Ensure Transparency and Equal Opportunities inthe Recruitment of New Personnel and for Matters Connected Therewith
 
Be IT ENACTED by the National Assembly of the Federal Republic of Nigeria as follows:
 
1.
It shall be the policy of the Government of the Federal Republic of Nigeria to promote efficiency in the allocation of personnel in the FederalCivil Service as well as transparency and equal opportunities in therecruitment and hiring of new personnel.
2.
It shall be the duty of all head of Federal Ministries, Parastatals,Corporations, Government Departments, Institutions, Commissions,Agencies, or any Government establishment, to (a) post in three (3)conspicuous places of their offices for a period of one month a complete listof all existing vacant positions in their respective offices which are to befilled, and (b) to transmit a copy of such list and corresponding qualificationstandards to the Federal Civil Service Commission not later than the tenthday of every month.

(1)
The Commission shall once every quarter compile and publish acomplete list of all the existing vacant positions in the Federal Civil Serviceincluding the qualification standards required for each position.
(2)
Copies of such publication shall be published in at least three nationaldailies with wide coverage.
(3)
Copies of such publication shall be pasted in the various personneloffices of the government establishments where they shall be available forinspection by the public.
(4)
Provided also that the Commission shall cause the said publication to be

posted in at least three public and conspicuous places in all States and LocalGovernment Areas of the Federation.
4.
As from the commencement of this Act, no vacant position in any Ministry,Parastatal,Corporation, Government establishment, shall be filled unless it isin accordance with the provisions of this Act.
5.

(1)
A person who violates the provisions of section 2, 3 and 4 of this Actand rules and regulations provided for implementation of same commits anoffense and is liable on conviction, to a fine not exceeding One HundredThousand Naira (N100,000.00), or imprisonment for a term of not more thanone year or both.
(2)
In the case of a statutory corporation or Government Department, wherethe offense is committed with the consent or connivance of, or is attributableto, any neglect or omission on the part of the Head of the Federal Ministry,Parastatal, Corporation, Government Departments, Institutions, Commission,Agency, or Government establishment, such Head or other official shall beliable under this Section.
6.
Report of any contravention of any of the provisions of this Act, to theNigerian Police by any person who is aware of such contravention.
7.
The Federal High Court shall have jurisdiction over all matters mentionedin this Act.
8.
The Attorney General of the Federation and Minister of Justice shall,subject to the approval of the President make regulations generally for thepurposes of giving full effect to this Act.
9.
As from the commencement of this Act any provision of any otherenactment or law with respect to the procedure of recruitment of newpersonnel that is inconsistent with the provisions of this Act is repealed in sofar as it affects matters under this Act.
