According to the data presented by Senator Zubiri, the counter protest proceeding should be dismissed on the ground that (1) Senator Zubiri’s projected net recovery cannot successfully overcome the net recovery you've posted, and; (2) In Senator Zubiri’s counter protest, the lection irregularities were merely alleged but not proven. ‘The data illustrates in Maguindanao were unbelievable, that Zubiri was credited 95 percent of the votes cast in that place. It also shows that the pilot precincts involved in the protest ‘were found to be spurious. I disagree with the counter-protest filed by Senator Zubiri because he failed to prove the electoral fraud and irregularities in his counter-protest. Rule 79 of the Revised Rules of the Senate Electoral Tribunal provides that the protestant should identify pilot precincts which consist of 25 percent of the contested precincts and if in these precincts at least 50 percent of the votes are spurious, then the recount for the remaining 75 percent should continue otherwise the protest should be dismissed. The pilot precincts involved in the protest did not show at least 50 percent of spurious ballots. Therefore the counter protest filed by Zubiri failed ‘o get the required number of votes which are spurious. Thus, his counter-protest failed to show valid cause of action, Because of these facts, the true sovereign of the people was disregarded by the fraud and irregularities. Therefore I believed that Atty. Aquilino L. Pimentel III is the real choice of the people in this election that his protest needs action immediately. God Bless.
