Governor Riley and Commander Tyson respectfully oppose Plaintiffs’motion to clarify and reconsider (Doc. 16) this Court’s scheduling order on theGovernor and Commander’s motion to dismiss to the extent that Plaintiffs arerequesting this Court to also set a hearing on their motion for a preliminaryinjunction. The Governor and Commander have moved to dismiss this entireaction under Rule 12(b)(6) (Doc. 13), and this Court’s order sets a briefingschedule and hearing for that motion. In light of the points raised in that motion todismiss, it would be contrary to the interests of both federalism and judicialeconomy to proceed with briefing and a hearing on Plaintiffs’ motion for
