Motion for Leave to File Amicus Brief In Support of Defendant-Intervenors-Appellants
Proposed
amicus curiae
, Catholics for the Common Good, respectfully moves this Court for permission to file an amicus brief inthis matter.Catholics for the Common Good advocates for a just societyusing reason based on principles of Catholic social teaching.Catholics for the Common Good is interested in this case, because thedistrict court’s opinion enshrined a re-definition of marriage inCalifornia law that may expose this and similar organizations andpersons of good will to claims of discrimination for continuing topromote the centrality and integrity of marriage between a man and awoman for the benefit of children and society. This re-definitionrenders marriage a mere private relationship for the benefit of adults, which will affect how people think about marriage and whether theydecide to get married, and will also adversely impact children, whohave a human right to a united family with their mother and father. An
amicus
brief will be of benefit to this court because theopening brief filed by Defendant-Intervenors-Appellants focuses ontwo rational bases for upholding Proposition 8, in preference to otherpotential rational bases. The brief filed with this motion argues that

the primary effect of Proposition 8 is to encourage the commonunderstanding of marriage as a union of a man and a woman, orientedtoward bearing and raising children. This primary effect constitutesanother rational basis for upholding Proposition 8.Respectfully submitted, /s/ Richard G. KaterndahlRichard G.
