Dear Mr. Horgan:
| am writing in response to your letter of September 16, 2010, regarding the departure of Mr. Gordon
‘Goodman from the BC Public Service and his acceptance of a position with EOG Resources inc.
‘All members of the BC Public Service are bound by the Standards of Conduct for the BC Public Service
which state:
Confidential information, in any form, that employees receive through their employment must not
be disclosed, released or transmitted to anyone other than persons who are authorized to receive
the information. Employees who are in doubt as to whether certain information is confidential
must ask the appropriate authority before disclosing, releasing or transmitting it. The proper
‘handling and protection of confidential information is applicable both within and outside of
government and continues to apply after the employment relations ends,
In addition, as you point out in your letter, there are additional Post Employment Restrictions for
Executives in the BC Public Service. In this case, Mr. Goodman asked, through his Deputy Minister, that
| consider whether his accepting the position of Manager, Health, Safety and the Environment with EOG.
Resources Inc. would, in and of itself, put him in a breach of the Post Employment Restrictions and, if so,
whether the employer would reduce the one year limitation on this restriction,
{n reviewing the circumstances presented in this case, and in consultation with the Deputy Minister to the
Premier, | concluded that accepting this position, in and of itself, would not be a violation of these
Testrictions. Notwithstanding this fact, Mr. Goodman was also reminded that the provisions of the policy
remain in place and any future actions should be guided by this during the period of the one year
restriction
‘Mr. Goodman acted appropriately by seeking advice on the provisions of the policy prior to accepting the
position with EOG Resources inc. He was forthcoming in providing answers to our questions regarding
the nature of this assignment and | am confident that he understands his obligations under this policy.
