If contextis ever going to matter, it has to matter in the contextof a funeral. Mr. Snyder simply wanted to bury his sonin a private, dignified manner. When the Respondents'behavior made that impossible, Mr. Snyder was entitledto turn to the tort law of the State of Maryland.JUSTICE SCALIA: Are we just talking about afuneral? That's one of the problems I have with thecase. There was also this video that -- that yourclient watched, right, later, after the funeral?MR. SUMMERS: There was a flier that wassent out prior to the funeral. We have the funeral andwe have what they described as the "epic," which was puton the Internet afterwards, which --JUSTICE SCALIA: Right. Well, what doesthat have to do with the funeral?3
