1 (e) A law enforcement officer shall issue to a person who the law
2 enforcement officer has probable cause to believe has violated
3 subsection (b) a summons and promise to appear under
4 IC 35-33-4-1 instead of arresting the person. A written statement
5 signed, under penalty of perjury, by:
6 (1) a school bus driver;
7 (2) a school bus monitor; or
8 (3) a crossing guard;
9 that affirms or attests that the person has violated subsection (b)
10 constitutes probable cause for purposes of this subsection.
11 SECTION 2. IC 9-21-12-1, AS AMENDED BY P.L.217-2014,
12 SECTION 52, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
13 JULY 1, 2019]: Sec. 1. (a) A person who knowingly or intentionally
14 drives a vehicle that:
15 (1) meets or overtakes from any direction a school bus stopped on
16 a roadway and is not stopped before reaching the school bus when
17 the arm signal device specified in IC 9-21-12-13 is in the device's
18 extended position; or
19 (2) proceeds before the arm signal device is no longer extended;
20 commits a Class A infraction. C misdemeanor.
21 (b) This section is applicable only if the school bus is in substantial
22 compliance with the markings required by the state school bus
23 committee.
24 (c) There is a rebuttable presumption that the owner of the vehicle
25 involved in the violation of this section committed the violation. This
26 presumption does not apply to the owner of a vehicle involved in the
27 violation of this section if the owner routinely engages in the business
28 of renting the vehicle for periods of thirty (30) days or less.
29 (d) A law enforcement officer shall issue to a person who the law

38 constitutes probable cause for purposes of this subsection.
39 SECTION 3. IC 35-52-9-19.8 IS ADDED TO THE INDIANA
40 CODE AS A NEW SECTION TO READ AS FOLLOWS
41 [EFFECTIVE JULY 1, 2019]: Sec. 19.8. IC 9-21-12-1 defines a crime
42 concerning traffic regulation.
