1 A BILL for an Act to create and enact a new section to chapter 5-02 of the North Dakota Century
2 Code, relating to alcohol breath analyzers; to provide a penalty; and to provide an effective
3 date.

4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:

5 SECTION 1. A new section to chapter 5-02 of the North Dakota Century Code is created
6 and enacted as follows:
7 Alcohol breath analyzer - Penalty.
8 A retail alcoholic beverage licensee that is not an exclusive off-sale licensee shall offer for
9 sale on the licensed premises alcohol breath analyzers or breath-alcohol test systems approved
10 by the federal food and drug administration. A person that violates this section is guilty of a
11 class B misdemeanor.
12 SECTION 2. EFFECTIVE DATE. This Act becomes effective January 1, 2020.
