POLICIES OF THE AD HOC CONSTITUTION COMMITTEE OF THE BURNS PAIUTE TRIBE

ARTICLE 1. AD HOC CONSTITUTION COtvIMITTEE. GENERALL Y

Section 1. Establishment. The Ad Hoc Constitution Committee of the Burns Paiute Tribe

("Committee") was created and formed by the Burns Paiute Tribe Tribal Council on. .:»

by Tribal Council Resolution No.______; pursuant tOIArticie VI, Section 1 (L) to regulate and define the duties and procedures of the tribal council, of all tribal council members andlor subordinate tribal committees and organizations and otherwise establish policies and procedures for tribal government personnel. the Constitution of the Bums Paiute Tribe.

Section 2. Purpose. The purpose of the Co~ttee is to study the Burns Paiute Tribe's Constitution ("Constitiltioil"), educate the Tribal community about the Coiistitution and the Secretarial Election process, seek community input on potential changes to the Constitution, and help the General Council evaluate, clarify, and amend the Constitution. The members of the Bums Paiute Tribe believe that comprehensive reform of the Tribe's Constitution is needed to increase the effectiveness, efficiency, and accountability of the elected Tribal govenunent and to strengthen the Tribe's sovereignty and self-determination. This Constitution reform. must reflect the culture and history of the Tribe-send must be strong enough to withstand future challenges for generations to come.

Section 3. Duration. The Tribal Council has created the Committee to fulfill a specific short-

term. purpose on behalf of the Tribal Council. The Committee shall report to the Tribal

Council. The Committee shall exist and function until it completes the Secretarial Election process, at which time it shall be dissolved by the Tribal Council.

Section 1. Purpose, The purpose of the Policies of the Ad Hoc Constitution Committee of

the Burns Paiute Tribe ("Committee Policies") is to establish a formal set ofmIes for the Committee that will enable the Committee to accomplish its purpose.

Section 2.

Approval. The Committee Policies were approved by the Tribal Council on ______ _;J by Tribal Council Resolution No. __ , and are effective as of such date.

Section 3. Amendments. The Tribal Council reserves the right to amend or revoke the Committee Policies at any time, with or without advance notice to the Committee. The Committee may propose amendments to the Committee Policies at any time in accordance with the following procedures:

(a) The Committee, by consensus based vote, may recommend proposed amendments to the Committee Policies.

(b) The Committee shall, in a timely manner, submit such proposed amendments to the Tribal C01UlCil for approval. Amendments shall have no force and effect until approved by the Tribal CounciL

ARTICLE III. COMMITTEE MEMBERSHIP

Section 1. Eligibility for Membership. To be eligible to serve on the Committee, a person must be a member of the Burns Paiute Tribe. at least eighteen (18) years. of age, and be able to attend at least one (1) meeting per month. No experience with Tribal government is necessary, but potential members should have an interest in Constitutional issues.

I i Section 2. Appointments. The Tribal Council shall solicit letters of intent from Tribal

members interested in serving on the Committee and shall appoint Committee members from among the eligible Tribal members who have expressed such an interest.

Section 3. Composition. The Committee shall be composed of a minimum of five (5) and a maximum of seven (7) voting members.

'(a) One member of the Committee shall be a member of the Tribal Council, appointed by the Tribal Council to serve as a liaison between the Tribal Council and the Committee. The Committee member serving as a Tribal Council liaison shall report on behalf of the Committee at Tribal Council and General Council meetings.

I (b) The Tribal Council may appoint additional members to serve on the Committee, in excess of the maximum allowed under this Section, if the Tribal Council finds that the number of members is insufficient to carry out the Committee's responsibilities.

I" Section 5: Terms and Vacancies. Committee members shall serve for a term consisting of

the time needed to complete the Secretarial Election process, or as otherwise designated by the Tribal Council.

(a) A member may be removed if a majority of the committee finds that the member has failed to appropriately perform his or her duties.

(b) Any Committee member wishing to resign from office shall submit official notice of his or her intent to resign, in writing to the Committee. The liaison will notify the Tribal Council of the vacancy.

(c) In the event of a vacancy on the Committee, the Tribal Council shall fill the vacancy, in accordance with this Article, within thirty (30) days of its notice of the vacancy.

Section 6. Travel Payment for any per diem, costs, and/or travel associated with Committee

work must be approved by the Burns Paiute Tribal Council.

ARTICLE IV. LIAISON

(a) Section 1. Liaison The Committee member serving as the Tribal Council liaison shall report on behalf of the Committee at Tribal Council and General Council Meetings. The Liaison will be responsible for keeping minutes, which shall include roll call, date and time of meeting and location. The liaison will be responsible for maintaining the correspondence from the attorney.

ARTICLE V. COMMITTEE RULES AND RESPONSmILITIES

Section 2. Primary Duty. The primary duty of the Committee is to work with the Tribal

community to discuss Constitutional provisions in need of reform and identify alternatives for resolving Constitutional issues. In carrying out this duty, the Committee shall educate the Tribal membership about the current Constitution and opportunities for involvement in the Secretarial Election process and shall seek maximum participation and input from the Tribal membership.

(a)

The Committee shall hold community work groups and other events with the Tribal membership. The Committee may also develop additional ways to solicit input from the Tribal membership.

(b)

The Committee is not vested with the authority to make decisions about Constitutional reform options, but is instead responsible for soliciting the opinions of Tribal members regarding Constitutional issues and ideas for solutions. The Committee shall document this input in writing, compile the information into one report, and present the report to the Tribal Council and General Council.

Committee members shall show respect for all opinions presented and shall record and report all input, suggestions, and alternatives received from the Tribal membership, regardless of the personal views of Committee members about preferred solutions to Constitutional issues.

Section 3. Additional Responsibilities. The Committee and its members shall be responsible

for carrying out the following additional responsibilities:

(a)

The Committee shall educate the Tribal membership about its mission, the Tribe's existing Constitution, and the Secretarial Election process.

The Committee shall post on the tribal website, which shall educate the Tribal membership about the Tribe's existing Constitution, the Secretarial Election process, and opportunities for participation.

(c)

The Committee shall provide updates in the Tribal newsletter, which shall educate the Tribal membership about the Tribe's existing Constitution, the Constitutional reform process, and opportunities for participation.

(d) The Committee shall provide reports to the Tribal Council on Committee activities, any problems with the process, and any other relevant information.

(e) At each regular General Council meeting, the Committee shall report to the General Council about the Committee's activities and opportmrities for Tribal member involvement in the Constitutional reform. process.

(1) The Committee shall identify materials and resources that might be useful for the Secretarial Election process.

ARTICLE VI. COMMITTEE MEETINGS

Section 1. Regular Meetings. The Committee shall attempt to hold at least one (1) regular

planning meeting per month at such place, time. and date as is designated by the Committee. The meeting date may beset by the Committee at the previous regular or special meeting. All meetings shall be open to all Bums Paiute Tribal members. The Committee may invite non-

I member guests to attend meetings.

I Section 2. Special Meetings. Special meetings may be called at the discretion of the

Committee. Every reasonable effort will be made to provide notice of the meeting to every committee member & the general membership.

Section 3. Community Meetings and Events. The Committee shall be responsible for

conducting community work group meetings, as well as other events to seek community input on Secretarial Election. Notice of each community meeting and event shall be given to each Committee member, published in the Tribal-newsletter, posted on the Tribe's website, and posted in conspicuous places on the Bums Paiute Reservation.

Section 6. Conducting Committee Meetings. During Committee meetings, Committee

members shall provide input on all matters before the Committee shall respect the opinions of others, even if they disagree with their views.

I ARTICLE VII. COMMITTEE RECORDS . I

Section 1. Property of Tribe. Meeting minutes, and other records of the Committee shall be considered the property of the Burns Paiute Tribe and shall be kept on file in the Tribal Council

office. I

ARTICLE VIII. FINANCIAL ACCOUNTABILITY

Section 1. Financial Decisions. All Committee financial transactions shall comply with the

Committee's approved budget, if any. Decisions on Committee purchases require prior approval

of the Committee, which shall be recorded in the meeting minutes. The Committee's purchasing procedures are as followed;

When ordering/purchasing with a purchase order (PO). the PO will be signed by two (2) Committee members along with the Finance Director's signature. The PO will then be taken to the Administration Secretary for a PO # and then items will be ordered by the Liaison or designated committee member. The top page of the PO will go to the Liaison for file and the 2nd and 3 rd page will go to the Accounting Department.

When paying an invoice with. a check request, the check request will be signed by two (2) Committee members along with the Finance Director's signature. Attached to the check request will be the invoice for the item(s ) purchased. Check request and invoice will then be turned into Accounting for payment. A copy will be made for the Committee's files.

Section 2. Financial Documentation. The Co~ttees shall document all financial

transactions, including, but not limited to, requests, donations, purchases, and travel vouchers. The Liaison shall be primarily responsible for the financial accountability of the Committee.

ATTENTION KIDS! There will be some glow in the dark swizzle glow necklaces provided by law enforcement to you before Halloween gets here. The only thing you need to remember is not to bend them before you go trick or treating because that activates the glow in the dark inside of it. The glow only lasts a few hours. These will be handed out at the tribal Halloween party.

DOGS: Remember that if you have a dog it must be licensed though the tribe in order to be on Reservation Property. The dog must have its Rabies shots and be licensed through the Tribe. We generally issue a citation to the owner of a non-licensed dog to insure they get the dog's rabies shots which is for the protection of the tribal residents. Ifwe locate a dog not licensed and cannot locate the owner then we take the dog to the Vet in town. It will cost $55.00 more to get the dog out.

Remember if you're feeding the dog it is presumed to belong to you, so call us if there are strays, and we can deal with them.

History of Red Ribbon Week-

Red Ribbon Week. began after the kidnapping, torture and murder of Drug Enforcement Administration (DEA) Agent Enrique "Klkl" Camarena in 1985. Agent Camarena had been working undercover in Guadalajara, Mexico for over four years. His efforts led to a tip that resulted in the discovery of a multimillion dollar narcotics manufacturing operation in Chihuahua, Mexico. In Agent Camarena's home town, Calexico, CA, the public outpouring of support turned in to an organized community response in which citizens wore red ribbons. Then, in 1988, Red Ribbon Week was recognized nationally with President Ronald and First Lady Nancy Reagan serving as the first Honorary Chairs. Today, the Red Ribbon Week brings millions of people together to raise awareness regarding the need for alcohol, tobacco and other drug and violence prevention, early intervention, and treatment services. It is the largest, most visible prevention awareness campaign observed annually in the United States.

• NOTE: If you do not arrive or call before 12:00 noon Saturday and you have not yet paid. your space will be given to the next available vendor.

• EZ ups or canopies are not allowed in Gymnasium. If you need to use a Canopy or EZ up we can set you up in the Weight Room. Weight Room spaces are 10 x 10.

• No selling of weapons and/or drug related items or items with any drug insignia.

If weapons or drug related items are found to be sold, we reserve the right to remove vendor from Chemawa Indian School Campus.

Chemawa Campus is a Smoke Free Campus. Please respect the rule and leave campus to smoke. Thank you.
