Dear Shri Raja,
Would you kindly refer to your 0.0. letter No. 1859/MOC&ITMIP/2010,
dated 24.8.2010 regarding reviewing the recognition rules of BSNL. You had
assured me “you are looking into the matter”. However on 16.9.2010 in a
meeting the BSNL management announced the daies of conducting the next
elections thereby closing the matter. In my last letter dated 31.7.2010 | had
drawn your attention to the judgement of High Court of Madras as well as
‘Supreme Court. The Supreme Court was more forthright in their judgement. Both
are against monopoly recognition,
Besides, BSNL management and Dy CLC ( C) had made commitment at
the time of last verification in 2008 that at the time of next verification they: will
draft new set of rules. This can be verified from BSNL No. BSNL-/5-1/SR/2008,
dated 18.12.2008. This is what GM(SR)-BSNL said
“at the end, GM (SR) also mentioned that the management is open to.
consider any change in the code of discipline in future. The new set of
rules can be drafted with the consent of all the unions at the time of next
membership verification for which action can be initiated approx six
months in advance, to which all the unions agreed unanimously”.
In his concluding remarks, DY CLC {C) further poirited out that
“the code of discipline is not a rulolstatute, but is a document
followed by all the arties for guidance purposes in connection with
membership verifications. The organisations are free to have different code
of discipline, as per their suitability and requirement, which can be taken
up in some other forum but not in this forum”
Keeping in view court orders referred to above and the assurance of the
BSNL and CLC(C), | would request you to agree to have more unions recognised
with more than 15% membership. This is within the competence of your
department.
