violation of PENAL CODE SECTION 422, a Felony, was committedby BRLINO E BRUHWILER, who
did willfully and unlawfully threatento commit a crime which would result in deathand greatbodily injury
to DEPUTY ESPINOZA, with the specific intent that the statementbe taken as a threat. It is further
alleged that the threatenedcrime, on its face and under the circumstancesin which it was made, was so
unequivocal,unconditional,immediateand specificas to conveyto DEPUTY ESPINOZA a gravity of
purposeand an immediateprospectof execution. It is further allegedthat the said DEPUTY ESPINOZA
was reasonablyin sustainedfear of hisftrersafetyand the safetyof his/herimmediatefamily.

OFFICER. in violation of PENAL CODE SECTION 69, a Felony, was committedby BRLINO E
BRUHWILER, who did unlawfully attempt by meansof threats and violence to deter and prevent DEPUTY
ESPINOZA. who was then and there an executive officer, from performing a duty imposed upon such
officer by law, and did knowingly resist by the use of force and violence said executive officer in the
performance of his/her duty.
