ObjectionstotheDraftQueanbeyanLocalEnvironmentalPlan(SouthTralee)2010.
Introduction
TheTuggeranongCommunityCouncil(TCC)wasformedin1983asanincorporated,voluntary,notforprofit,nonpolitical,communitybasedassociation.TheTCCisformallyrecognisedasthepeakcommunityrepresentativebodyofsome100,000residentsoftheTuggeranongValley.TheTCCmeetsonaregularbasisandworkswithGovernments,othercommunitygroupsandorganisationstoimprovefacilities,services,thegeneralamenityandtheenvironmentoftheTuggeranongValley.Inearly2010,theTCCundertookasurveyofTuggeranongresidentstomeasureopinionandcancommentfromthecommunityonthedevelopmentofTralee.Ofthesurveyrespondents,70%believethatflightpathswilladverselyaffecttheresidentialamenityofTuggeranong(Attachment1).TheTuggeranongCommunityCouncilobjectstotheproposedresidentialdevelopmentatSouthTraleeonthefollowinggrounds;

TheTCCisoftheopinionthattoapproveresidentialdevelopmentwithintheapproachflightpathofCanberraAirportwillpreventtheachievementofa
“ahighlevelofresidentialamenity” 
duetotheoverflyingairtrafficandtheassociatedproblemscausedbythis.

2.Part7.Additionallocalprovisions.
7.1AirspaceOperations[local](1)Theobjectivesofthisclauseareasfollows:(a)toprovidefortheeffectiveandon-goingoperationoftheCanberraAirportbyensuringthatsuchoperationisnotcompromisedbyproposeddevelopmentthatpenetratestheObstacleLimitationSuraceforthatairport,(b)toprotectthecommunityfromundueriskfromsuchoperations.
TheTCCbelieves,thatasCanberraInternationalAirportistheonlycapitalcityairporttohaveadedicated,residencefree,flightapproachpath,anyresidentialdevelopmentwithinthepathareawillimpactuponoperationoftheairport.Forexample,Sydney’sMascotAirportissubjecttoanightcurfewthatrestrictsarrivalanddeparturetimesofallairtraffictobetween6amand11pm.SucharestrictiononCanberraairportwouldseriouslyaffectthefuturedevelopmentofCanberraasa24hourfreighthub.Clearly,residentialdevelopmentofTraleewouldcompromisethefutureoperationoftheairportandwouldthusbecontrarytotheobjectivesofthisclause.
Thestatementthattheon-goingoperationwillnotbeaffectedmerelybyensuringnodevelopmentstructurepenetratestheObstacleLimitationSurfacedoesnotacknowledgethedirectimpactofresidentsbyaircraftnoiseandfueldumping.HeightrestrictionshavenobearingonnoiseissuesandtheQueanbeyanCityCouncilisbeingnarrow-mindedanddeliberatelywordingaclauseinsuchawayastoonlytechnicallyarguethefutureimpactontheairspaceoperationsandfliesindirectcontradictiontothepolicybywhicharesidence-freeflightpathapproachwasdeveloped.

3.Part7.2Developmentinareassubjecttoairportnoise[local]
(1)Thisclauseappliestoalllandsubjecttothisplan.(2)Beforedeterminingadevelopmentapplicationfordevelopmenttowhichthisclauseapplies,theconsentauthority:(a)
 
mustconsiderwhetherthedevelopmentwillresultinanincreaseinthenumberofdwellingsorpeopleaffectedbyaircraftnoise,and(b)
 
mustconsiderthelocationofthedevelopmentinrelationtothecriteriasetoutinTable2.1(BuildingSiteAcceptabilityBasedonANEFZones)inAS2021-2000,Acoustics-Aircraftnoiseintrustion-buildingsitingandconstruction(c)
 
mustbesatisfiedthatthedevelopmentwillmeetAS2021-2000,Acoustics-Aircraftnoiseintrustion-buildingsitingandconstructionwithrespecttointeriornoiselevels
TheTCCbelievesthattheconsiderationwithrespecttothenumberofdwellingsofpeopleaffectedmustextendbeyondtheborderofNSWandtakeintoaccounttheestablishedresidentialsuburbsoftheACTwhichwillbeimpactedbyamendmentstoflightpathsifTraleeisapprovedpertheACTChiefMinister’scommentswithrespecttoawholeofregionconsideration(ACTChiefMinisterJonStanhope,mediarelease27April2007:Traleeapoorplanningoutcomeforregion@http://bit.ly/stanhopetralee)whenhestated:
“Building homes at these locations will do three things: it will undermine theCanberra International Airport’s attempt to divert air traffic away fromJerrabomberra; it will lead, over time, to calls for Canberra residents to sharethe burden of aircraft noise; and, again over time, it will create pressure for there to be a curfew on the airport’s operations, thereby affecting its capacityto operate as a economic driver for the regional economy. In addition, locatinghomes right next to Hume – the ACT’s second largest industrial estate –needlessly creates the prospect that NSW will one day try to restrict particular kinds of industrial development, as being incompatible with residentialdevelopment.“I am also bemused by the decision by the Jerrabomberra ResidentsAssociation to support residential development in the airport noisecorridor, apparently in exchange for a new school and aquatic centre.The result, within a very short period, will be more aircraft noise for thepeople of Jerrabomberra. I fear this is a deal the residents of Jerrabomberra will quickly come to rue.”
WhilethisLEPisnotproposinganyresidentialzoneswithinthe25ANEFcontour,itdoesinclude19hectaresinregionbetweenthe20–25ANEFcontours.Theresidentialzone
