INTRODUCTION
This report presents inormation on Trafc Penalty Tribunal activity or the period 1 April 2008 to 31 March 2009. It is the frst time that annual statistical inormation has been published in this stand-alone ormat and it is proposed that the Tribunal’s annual statistics will be published thisway in the uture.
2008/09 represented a period o legislative change in civil parking enorcement with theintroduction o the Trac Management Act 2004. However it should be borne in mind that thestatistics in this report will also include cases that were decided under the Road Trac Act 1991which was replaced by the new legislation on 31st March 2008.Over orty new councils commenced civil parking enorcement during 2008/09 and this isrefected in table 6 by the number o penalty charge notices (PCNs) issued when compared to2007/08. Taking councils who have been in the scheme since 2006/07 or longer, 47% o thosecouncils issued less PCNs in 2008/09 than in 2007/08, 23% issued more and the remaining 30%o councils could not be compared as they had not been enorcing long enough or a meaningulcomparison to be made.Whilst the number o appeals increased in 2008/09, the rate o appeal per PCN did not changesignicantly. The proportion o motorists’ appeals that were not contested by the enorcing councilincreased slightly whilst the proportion o appeals allowed by the Adjudicator remained static.Appeals against parking PCNs issued by Welsh Councils are detailed within the report which alsoincludes inormation on appeals received in respect o PCNs issued by the relatively small numbero English councils undertaking civil bus lane enorcement and/or clamp and tow-away.A copy o this report is available or download romwww.patrol-uk.ino
