COMMISSION REGULATION (EC) No 247/2001of 5 February 2001re-establishing the preferential customs duty on imports of uniflorous (bloom) carnations origin-ating in Israel
THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the EuropeanCommunity,Having regard to Council Regulation (EEC) No 4088/87 of 21December 1987 fixing conditions for the application of prefer-ential customs duties on imports of certain flowers originatingin Cyprus, Israel, Jordan and Morocco and the West Bank andthe Gaza Strip (
), as last amended by Regulation (EC) No1300/97 (
), and in particular Article 5 (2) (b) thereof,Whereas:
Regulation (EEC) No 4088/87 fixes conditions for theapplication of a preferential customs duty on large-flow-ered roses, small-flowered roses, uniflorous (bloom)carnations and multiflorous (spray) carnations within thelimit of tariff quotas opened annually for imports of fresh cut flowers into the Community.
Council Regulation (EC) No 1981/94 (
), as last amendedby Commission Regulation (EC) No 563/2000 (
), opensand provides for the administration of Community tariff quotas for certain products originating in Algeria,Cyprus, Egypt, Israel, Jordan, Malta, Morocco, the WestBank and the Gaza Strip, Tunisia and Turkey, andproviding detailed rules for extending and adapting thesetariff quotas.
Commission Regulation (EC) No 246/2001 (
) fixedCommunity producer and import prices for carnationsand roses for application of the arrangements forimportation from the countries in question.
Commission Regulation (EEC) No 700/88 (
), as lastamended by Regulation (EC) No 2062/97 (
), laid downdetailed rules for the application of these arrangements.
The preferential customs duty fixed for uniflorous(bloom) carnations originating in Israel by Regulation(EC) No 1981/94 was suspended by Commission Regu-lation (EC) No 124/2001 (
On the basis of price recordings made as specified inRegulations (EEC) No 4088/87 and (EEC) No 700/88 itmust be concluded that the requirement for reintroduc-tion of the preferential customs duty laid down inArticle 2 (4) of Regulation (EEC) No 4088/87 is met foruniflorous (bloom) carnations originating in Israel. Thepreferential customs duty should be reintroduced.
In between meetings of the Management Committee forLive Plants and Floriculture Products, the Commissionmust adopt such measures,
HAS ADOPTED THIS REGULATION:
1. For imports of uniflorous (bloom) carnations (CN codeex 0603 10 20) originating in Israel the preferential customsduty set by Regulation (EC) No 1981/94 is reintroduced.2. Regulation (EC) No 124/2001 is hereby repealed.
This Regulation shall enter into force on 7 February 2001.
