Dear FOIA Officer, Federal Communications Commission:Pursuant to the federal Freedom of Information Act, 5 U.S.C. § 552, I request access to and copies of adocument identified as per the following attributes:1. The proposal, framework document, draft Order or similarly named document which has a subjectmatter relative to a proposed Open Internet / Network Neutrality proceeding, rule making, or otherregulatory process of the Federal Communications Commission (FCC); and which,2. Was communicated to, forwarded to, or otherwise transmitted to the Commissioners of FCC byChairman Genachowski, and/or by staff in the Office of the Chairman; and which,3. Was thus transmitted to Commissioners during either the evening hours of Tuesday, November30, 2010, or the early morning hours of Wednesday, December 1; and which,4. Is the subject of the Chairman's webcast speech, and published remarks of Wednesday morning,Dece
mber 1, as such remarks are entitled “
REMARKS ON PRESERVING INTERNET FREEDOM ANDOPENNESS
,” and as such remarks are published by FCC
via its website at:
http://www.fcc.gov/Daily_Releases/Daily_Business/2010/db1201/DOC-303136A1.pdf ;and which,5. Has been the subject of significant analysis, controversy, debate, and speculation by Membersof Congress, journalists, corporations, trade associations, public interest groups, and the like; and which,6. Must be released by the Commission immediately to be in compliance with the letter and thespirit of the Freedom of Information Act, as there is an overwhelming public interest in seeing the actualproposal of the Chairman itself.I am requesting that this document, of great interest to the American public, be released immediately,and communicated to me at my email address, and/or immediately published by the Commission on itswebsite.My intent, upon receipt of the document, is to publish same immediately via the web resources of mypublication called StimulatingBroadband.com.My purpose in doing so, and in making this request, is to see that the American public is informed about this important policy matter.The Commission should routinely release to the public such regulatory / rule making proposals.
