Delivery
Bacto aim for 2-3 day delivery. This may
not be possible for Dangerous Goods
(designated as *HAZ), or when late orders
are received.
Availability
The items and pack sizes shown in the
Product List are normally carried in stock.
All export prices are quoted F.O.B. Standard
export packaging is included where this is
deemed necessary by us. The Seller reserves
the right to increase the price from that
advised in the acknowledgment of the order, if
such increase is due to any change in
Government regulations, or any other cause
beyond the Sellers reasonable control.
Any costs incurred on account of delays,
interruptions or suspension of work due to
any act or omission of the Buyer shall be

PRODUCT LIST 1
Conditions of Sale
1. Quotations.
The acceptance of any quotation includes the acceptance of
the following terms and conditions except in so far as any of
them have been varied or are inconsistent with the quotation.
Quotations do not constitute an offer, are for information only
and not binding until an order has been accepted by the
Seller in writing. The Seller reserves the right to revise
quoted prices.
2. Description.
The descriptions and illustrations contained in any
catalogues, price lists and other advertising material are
intended merely to present a general idea of the goods
described therein and none of these shall form part of any
contract.
Note: Some items are included in “The Oxoid Manual” and
“International Product List” and not the Price List. These
items are not available in Australia at present or are
prohibited by quarantine; therefor, when ordering please
refer to the Price List. Some of these items could be
available on an “indent only” basis.
3. Prices
All Australian prices are quoted ex stock and are submitted
without obligation and subject to change without notice.
All export prices are quoted F.O.B. Standard export
packaging is included where this is deemed necessary by
us. The Seller reserves the right to increase the price from
that advised in the acknowledgment of the order, if such
increase is due to any change in Government regulations, or
any other cause beyond the Sellers reasonable control.
Any costs incurred on account of delays, interruptions or
suspension of work due to any act or omission of the Buyer
shall be added to the price.
All Items purchased (including handling charges), will be
subject to a 10% Goods and Services Charge (GST).
4. Delivery
Delivery shall be deemed to be effected:
(i) On receipt of signed copies of dispatch notes.
(ii) Save as provided in subclause
(iii) below when the goods have been collected from the
Seller’s works or have remained uncollected for a period of 7
days after the agreed date of collection, or
(iv) Subject to prior written agreement by the Seller when:
Goods have been delivered at the address agreed between
Seller and the Buyer, or
(v) All risks in relation to the goods will pass to the Buyer
upon delivery in accordance with these conditions unless
otherwise agreed in writing by the Seller and the Buyer.
Please note that unless otherwise advised, we always
dispatch by the most economical means, taking due account
of the life, storage and use of the product concerned.
5. Failure to Make or Take Delivery
(i) Dates given for dispatch / and or delivery are given in
good faith and the Seller will use reasonable endeavours to
dispatch or deliver on such date.
(ii) Not withstanding the foregoing the Seller shall not be
liable for late dispatch or delivery howsoever caused, nor
shall failure to dispatch be deemed to be in breach of contract.
(iii) If the Buyer or his consignee fail to take delivery of the
goods or any part thereof on the dates and at the places
agreed the Seller will be entitled to cancel such delivery and
all other outstanding deliveries and to charge the Buyer with
any loss suffered.
6. Notifiications
(i) All claims for damage to or partial loss of goods in transit
shall be submitted in writing to both the Carrier and the Seller
within 5 days of delivery.
(ii) All claims for non-delivery of the whole or any part of any
consignment must be submitted in writing to the Carrier and
the Seller within 10 days of the Sellers invoice or advice note
in the case of deliveries within Australia and within 28 days in
the case of deliveries outside Australia, or such longer period
as agreed in writing between the parties.
(iii) The Seller shall not be liable for loss or damage to the
goods after delivery as defiined in condition 4 above.
In the absence of notifiication of claim within the times
mentioned above the goods shall be deemed to have been
delivered in accordance with the contract.
7. Packages
Containers in which the goods are delivered are non-
returnable unless otherwise described. Containers which
are advised as returnable will be charged by the Seller but
will be credited in full if returned to the Seller carriage paid in
good condition within 60 days of delivery.
8. Descriptions and Warranties
(i) The description of the goods specifiied by the Seller shal
be the basis of each invoice.
(ii) In the event of a claim by the Buyer that the description
cannot be agreed or the goods are otherwise defective
through faulty materials or workmanship by the Seller, then
the Seller must be notifiied in writing within 28 days o
delivery.
(iii) No such claim as is mentioned in (ii) will be accepted
unless and until the Seller has had reasonable opportunity to
satisfy itself that the Buyer’s claim is proved to the Seller’s
satisfaction.
(iv) The Seller warrants that the goods delivered to the Buyer
shall be of merchantable quality and shall comply with the
description referred to in the contract. The Seller’s liability is

limited to the price of the goods proved to be defective and
for this purpose the price shall be deemed to be the invoiced
price of the goods. The Seller shall be entitled to replace
such goods upon the terms hereof in full settlement of it’s
liability.
(v) All recommendations and advice given by the Seller , its
servants or agents to the Buyer as to the mode of using the
goods are given without liability on the part of the Seller and
no responsibility will be accepted by the Seller for any injury,
loss or damage whatsoever or howsoever arising directly or
indirectly from use of the goods.
(vi) Save as herein expressly provided the Seller accepts no
liability on behalf of itself, its servants or agents for any loss,
damage costs or compensation howsoever caused which
the Buyer may suffer or for which the Buyer may become
liable arising out of or in connection with or as a result of the
supply of goods or failure to supply goods by the Seller.
9. Returns of Goods Supplied
Every effort will be made to exchange or credit Oxoid goods
in a manner which will be fair and just to our customers.
However, in pursuing this policy certain conditions must be
adhered to. Return of goods for exchange or credit will be
allowed only if they comply with the following conditions:
1. Claims regarding broken or damaged goods must be
made immediately on receipt.
2. The product must appear in the current Oxoid Price List.
3. The product must not have been purchased at special
discount rates or have been a bulk buy or special formula.
Items purchased at special rates can only be credited at the
same rate.
4. The product must be in its original unopened container
and the label should not have been removed or otherwise
tampered with.
5. Dated products are not accepted for credit under normal
circumstances.
6. Indent items especially procured for customers are not
normally returnable.
Products returned are subject to our valuation without
recourse. We reserve the right to destroy any goods which
are unfiit or unsafe for sale.
Exceptions to the above are:
(a) Goods which are faulty or damaged when received by the
customer and where the responsibility lies with Oxoid.
(b) Goods supplied in error directly by Oxoid.
In both (a) and (b), any claims should be made within 10
days of receipt of the goods.
10. Procedure for Returns
All claims should fiirst be referred to Oxoid and are subjet to
approval under the conditions outlined above. No goods may
be returned without the Seller’s consent being given in writing.
Freight charged for the return of the goods is to be paid by
the consigner except in the case of exceptions as above, or
should Oxoid recall a product. Packing list number and date
must be supplied.
11. Force Majeure
If by reason of fiire, accidents, war, strikes, lockouts, riots
civil commotion Government prohibition or restriction of any
other cause (whether or not of the same nature as the
foregoing) beyond the reasonable control of either of the
parties the Seller is prevented from or delayed or hindered,
in effecting dispatch or making delivery of the goods or any
part thereof at the times or places stated for delivery then a
reasonable extension of time shall be granted or if
appropriate delivery abandoned without penalty. In any
event the Seller shall not be liable in any way for loss or
damage arising directly or indirectly through or in
consequence of any such events or happenings.
12. Terms
(i) Terms of payment for delivery to Australian customers are
net cash within 30 days of the date of invoice.
(ii) Terms for deliveries to customers outside Australia are:
(a) cash against delivery of shipping documents, or
(b) shipment against irrevocable Letter of Credit,
confirmed for payment in Australian Dollars by an
Australian Clearing Bank, or
(c) Bill of Exchange accepted by approved customers.
(d) All payments are due in Australian Dollars.
(iii)The right is reserved (without prejudice to any other
remedy) to cancel any uncompleted order or to suspend
delivery in the event of any of the Buyer’s commitments not
being met, or if the Seller is of the opinion that the buyer is
not in a position to meet such commitments.
(iv) The Seller reserves the right to levy an interest charge of
8.5% per month for any account remaining unpaid after 30
days from the date payment is due hereunder.
13. Default
Should default be made by the Buyer in paying any sum due
under any contract as and when it becomes due or if the
Buyer should commit an act of bankruptcy or enter into
liquidation or if a Receiver of the Buyer’s assets be appointed
or any arrangement or composition be made with creditors
then the Seller may at its sole discretion without notice in
writing suspend or terminate any contract then in being so far
as any further goods remain to be delivered without
prejudice to any claim or right the Seller may otherwise make
or exercise.
14. Retention of Title
(i) The property in any goods supplied by the Seller to the
Buyer shall remain with the Seller until those goods are paid for.
(ii) Furthermore, the property in any such goods will continue
to remain with the Seller until the Buyer has paid to the Seller
all sums due to the Seller from the Buyer on any other
account whatsoever provided always: the Buyer may unless
and until he receives notice from the Seller to the contrary sell
such goods but only in the ordinary course of the Buyer’s
business and only to an independent third party in an arms
length bona fiide transaction at full market value or a prope
trade discount. Save as aforesaid the Buyer shall not sell
charge or otherwise dispose of any goods belonging to the
Seller or of any interest in such goods and unless and until
such goods are sold as aforesaid by the Buyer the Seller may
at any time require the Buyer to deliver up the goods to the Seller.
(iii) The Buyer shall account to the Seller for the proceeds of
sale or otherwise of the goods, whether tangible or
intangible, including proceeds separate from any monies or
property of the Buyer and third parties, and, in the case of
tangible proceeds, properly stored, protected and insured.
(iv) Until such time as the property in the goods passes to the
Buyer, the Buyer shall hold the goods as the Seller’s fiiduciar
agent and bailee, and shall keep the goods separate from
those of the Buyer and third parties and properly stored,
protected and insured and identifiied as the Seller’s property.
15. Patents
(i) In the event of any claim being made against the Buyer in
respect of infringement or alleged infringement of Letters
Patent Registered design or similar right relating to the
Seller’s goods supplied to the Buyer then the Buyer shall
notify the Seller immediately and the Seller shall be at liberty
with the Buyer’s assistance, if required, but at the Seller’s
expense to conduct all negotiations in the Buyer’s name for
the settlement of the same or any litigation which may arise
therefrom. Subject to such notifiication and providd that no
such goods or any part thereof shall be used for any purpose
other than that for which the Seller shall supply them the
Seller will indemnify the Buyer in respect of any sum
exceeding the total contract price.
(ii) Where goods are at the Buyer’s request made and
supplied by the Seller other than to the Seller’s own
specifiication the Seller accepts no liability for infringement o
alleged infringement of any Letters Patent registered design
or similar right in respect thereof and the Buyer will indemnify
the Seller against any such claims.
(iii) So far as concerns goods supplied other than of the
Seller’s own manufacture the Buyer will be entitled only to
such indemnity in respect of infringement or alleged
infringement of Letters Patent Registered Design or similar
right as the Seller may obtain from the Seller’s supplier and
provided that the Seller is not called upon to bear any liability
or expense greater than the amount recovered from the
Seller’s supplier.
(iv) The Buyer shall do nothing which would or might vitiate
any policy of insurance or insurance cover which the Buyer
may have in relation to such infringement, and this indemnity
shall not apply to the extent that the Buyer recovers any sums
under such policy or cover(which the Buyer shall use its best
endeavours to do).
(v) Without prejudice to any duty of the Buyer at common law,
the Seller shall be entitled to require the Buyer to take such
steps as the Seller may reasonably require to mitigate or
reduce any such loss, damages, costs or expenses for which
the Seller is liable to indemnify the Buyer under this clause.
16. Warranties
The Buyer shall not make any representation or warranty
concerning the goods more extensive than or inconsistent
with the warranties set out in condition 8 (iv) herein and shall
not incur any liability therefor to any other party for the Seller.
17. Cancellation
Defects in quality or quantity of any of the goods delivered
shall not be a ground for cancellation of the remainder of any
order for the goods.
18. Indemnity
The Buyer shall indemnify, defend and hold harmless the
Seller from all losses, claims, demands, damages, costs and
liabilities to which the Seller may become subject in so far as
they arise out of:
(i) any breach or alleged breach by the Buyer of any
obligations under this agreement, or
(ii) the Buyers mishandling of the goods, or
(iii) any negligent act or omission by the Buyer or its
employees, agents or subcontractors.
19. Governing Law
The interpretation and purpose of any contract and of these
conditions will be governed by Australia Law.
20. Product Recall.
In the event of a recall of any of the products by
governmental agency or authority of competent jurisdiction
or if a recall is considered necessary by the manufacturer
and Oxoid Australia, such recall may be notifiied to the Buye
by telephone, fax or mail and the Buyer shall use best
endeavours to promptly implement and administer the recall
in a manner which is appropriate and reasonable under the
circumstances and in conformity with accepted trade
practises. In the event that a recall is required because any
of the products fail to conform with any product
specifiications or at the express request of the manufacture
and Oxoid Australia, then Oxoid Australia shall reimburse the
Buyer for the price of all products. In the event that a recall
is required as a result of the Buyer’s breach or alleged
breach of its obligations hereunder, all costs and expenses
incurred in connection therefore shall be borne by the Buyer.

Listeria Rapid Test EMMAS APPROVED

The Oxoid Listeria Rapid Test enables food manufacturers to detect the presence of Listeria organisms in their products or processing equipment in less than half
the time taken by traditional methods.
The test protocol has been developed to coincide conveniently with the working hours of the laboratory, providing a clear result two days after the sample has been
received.
Enrichment Broth System
Culture of the test sample is in two sequential enrichments, taking 42 hours. Any Listeria organisms present in the food or environmental sample are selectively
enriched using growth conditions which are optimal for flagella expression.
Antigen Extraction
The second enrichment medium is heated at 80°C for 20 minutes to extract the flagella antigen.
Listeria Device
The Listeria Device contains monoclonal antibodies specific to the B flagella antigen, that is common in most Listeria species.
The extracted antigen is added onto a pad in the Sample window. This contains blue latex labelled with antibody. The extract rehydrates the complex and the specific
antigen reacts, if present, with the antibody.
The complex moves through the pad by capillary action to a test strip. A further reaction between antigen/latex complex and the fixed antibody results in a blue line
in the Result window.
The device also provides an integral Control window.

Salmonella Rapid Test APPROVED
The Oxoid Salmonella Rapid Test is for the presumptive detection of motile salmonellae in raw food materials, finished food products and factory
environmental samples.
Traditional methods generally take between 3 and 5 days compared to the Oxoid Salmonella Rapid Test which provides results within 42 hours. In extensive trials
the test has proved accurate, reliable and easy to use across a wide range of foodstuffs.
Salmonella Rapid Test Elective Medium (SRTEM-CM857)
A selective enrichment broth medium specifically formulated for use with the Oxoid Salmonella Rapid Test. When made up according to directions, the double strength
broth is ready for immediate use.
Salmonella Rapid Test (FT201)
The Salmonella Rapid Test comprises a unique culture vessel housing two tubes, each tube contains a lower selective medium and an upper indicator medium.
Tube A contains modified Rappaport-Vassiliadis and Lysine Iron Cystine Neutral Red, whilst Tube B contains Lysine Iron Desoxycholate and modified Brilliant Green.
Once the culture vessel is prepared by rehydration of the media, an aliquot of sample is added. Any motile salmonellae present will migrate actively through the tubes
where their presence will be indicated by colour changes in the upper indicator media.
Salmonella Latex (FT203)
A latex agglutination test for the presumptive identification of salmonellae isolated by the Oxoid Salmonella Rapid Test. A wide range of Salmonella flagellae antibodies
have been purified and used to sensitise latex particles. When a loopful of material from the Salmonella Rapid Test tube is mixed with a drop of latex reagent,
agglutination will occur, if salmonellae are present.

Antimicrobial Susceptibility Testing System
The Oxoid Disc Dispenser Mk III
An enhanced system for antimicrobial susceptibility testing incorporating the new ergonomically designed Disc Dispenser. It has a simple one-
handed operation and is fully height-adjustable to cater for various depths of media. The cover and base of the dispenser are fully interlocked to
prevent the ingress of moisture; cartridges ‘click’ positively into their correct locations and a plastic skirt ensures that each agar plate is precisely centred every
time the dispenser is used.

Oxoid Antimicrobial Susceptibility Discs in Cartridges

Please Note – Ejectors are required when using cartridges individually. Discs containing special antibiotic concentrations can be made to order in
minimum quantities of 1000 cartridges subject to technical suitability.

Antimicrobial Susceptibility Discs

Disc storage. Discs in routine use should be stored at 2 to 8°C. Longer term storage should be at –20°C. After cold storage allow discs to reach room temperature
before opening storage containers.

Discs are presented in cartridges for dispensing either individually with Oxoid ejectors or with the Oxoid Dispenser System. There are 50 discs per cartridge, 5
cartridges per pack. All antimicrobial susceptibility discs are now presented in multi-language format.

Cartridge Packs
Each cartridge is individually sealed together with a silica gel capsule in a foil covered see-through blister, designed to allow the microbiologist better control and
storage of the discs in use.

Diagnostic Discs
Oxoid Diagnostic Discs are now supplied in single cartridge form (the same packaging as for antimicrobial susceptibility discs). Consequently, they
may be used in the Oxoid Disc Dispensing System.
Diagnostic Discs should be stored at 2 to 8°C. They may also be stored in the freezer (–20°C).
DD4 and DD5 are best stored at –10°C to –20°C.

The MicroLog system uses Carbon Source Utilisation to identify over 1,500 different organisms. When an organism is introduced into the wide variety of
